Following statements by Sali Berisha and media close to him that the United States has removed his "non grata" status, the US State Department has reacted to the "Pamphlet".
In the statement sent to our editorial team, the State Department does not speak of annulling the 2021 decision or lifting the “non grata” declaration. Instead, the term “waiver” is used, a special exception that can be granted for reasons related to the national interest of the United States.
“ The State Department has issued waivers to some of the Section 7031(c) designations imposed by the previous administration because granting these waivers serves a significant national interest ,” a State Department spokesperson told the Pamphlet.
This is the entire response from the State Department. What is striking is that not a single line states that the decision by which Sali Berisha was declared ineligible for entry into the US has been revoked. The terms "revocation", "cancellation", "removal" or "abolition" of the determination are not used. But the term "waivers" is used.
A "waiver" does not necessarily mean that the original decision has been overturned. It means that, for certain reasons (often related to the national interest of the United States), the person or entity benefits from an exemption from the consequences of that decision: the travel restriction does not apply in a particular case, the person is allowed to enter the United States for specific reasons, etc. For example, a sanctioned official must attend the UN, must meet with the US administration, a political figure is needed for negotiations. Then a waiver is granted.
The other element is that on May 19, 2021, then-Secretary of State Antony Blinken publicly declared Sali Berisha and his family ineligible for entry into the United States due to alleged involvement in significant corruption.
The decision did not only affect the former prime minister. Along with him, his wife, Liri Berisha, daughter Argita Malltezi, and son Shkëlzen Berisha were also declared ineligible to enter the US.
If there were talk of a complete removal of the 2021 designation, logically there would also have to be a clarification on the status of family members included in the same decision. But the State Department's response does not provide any details in this regard.
It does not clarify whether the exemption applies only to Sali Berisha, whether it includes his family members, or whether it concerns other cases sanctioned under Article 7031(c).
What is officially confirmed is that the US administration has issued exemptions to some determinations made by the previous administration, arguing that such action serves the national interest of the United States. Beyond that, many questions still remain unanswered. / Pamphlet
