The US has granted 61 waivers without necessarily lifting sanctions

“ The Department of State has issued exemptions to some of the determinations under section 7031(c) imposed by the previous administration, as granting these exemptions serves an important national interest ,” a State Department spokesperson told the Pamphlet.
However, a report by the American organization Human Rights First , based on data provided by the State Department itself, shows that the Waiver mechanism has been frequently used by the US without necessarily implying the lifting of sanctions.
According to the report, during the period December 2020 – December 2024, the State Department sanctioned a total of 486 individuals under the 7031(c) program, which is used for foreign officials and their family members when there is “credible information” of significant corruption or serious human rights violations.
Of these, 367 cases were made public, while 119 were kept confidential. But the most interesting part of the report is related to waivers.
“ The State Department waived several visa bans through waivers, almost all of them because of a ‘compelling national interest.’ The new data shows that it issued waivers citing a ‘compelling national interest’ 61 times during this period ,” the report said.
Human Rights First explains that the vast majority of these cases involved individuals accused of human rights violations and not corruption.

The American organization notes that despite the existence of waivers, it is difficult to say how many of the sanctions have actually disappeared.
“ Despite these data, it is difficult to say how many of the visa bans imposed during this period were overturned by waivers. However, the waiver of approximately one-eighth of the number of visa bans imposed during this period is significant and likely corresponds to dozens of official visits by individuals that the State Department found to be corrupt or abusive ,” it further states.
The report also brings another significant statistic: During the same period, the US has allowed sanctioned individuals to enter American territory on 10 occasions to participate in United Nations activities in New York.
“ The State Department also reported 10 instances of allowing a detained person to travel to the United Nations in New York during this period ,” the report states.
Essentially, the Human Rights First document shows that the American system foresees situations where a sanctioned person can benefit from an exemption for diplomatic or national interest reasons, without the need for the initial decision to be overturned.
The only one who can decide to cancel the designations is the Secretary of State, but even then in very specific cases. So far there has been no decision from Marco Rubio. / Pamphlet
