The full debates held in this Thursday's session at the Special Court are revealed, where former MP Monika Kryemadhi clashed with SPAK prosecutor Sotir Kllapi, regarding the evidence administered by the prosecution.
The mayor requested the invalidation of the evidence taken from the mobile phone that was seized during the search of her apartment, claiming that she could not be subjected to such a search without the authorization of the Assembly, as at that time she enjoyed the status of a member of parliament.
She also requested that SPAK make available all minutes and expert reports of the phone, claiming that not all evidence on which the charges were filed had been submitted.
On the other hand, prosecutor Sotir Kllapi responded that all procedural acts and minutes are in the file folders made available to the court, adding that the phone was found in Fatime Kryemadhi's apartment and, at the time of seizure, it was not known that it belonged to Monika Kryemadhi.
The debate escalated further when the former MP described the accusation against her as "sexist", claiming that SPAK is trying to portray her as someone who acted only on the instructions of Ilir Meta.
Below are the full arguments held in the courtroom:
Monika Kryemadhi: I would like SPAK to inform us about the minutes and what observations were made on the seized phone. We have requested it in all sessions. I have been denied the right to be equal in trial by the investigative body. I only signed the minutes of the receipt of 5 disks. It does not exist in them, and even on disk 3 there are some files that do not open. This phone on which charges have been filed, what expertise was performed? I do not have this in the file, when it was examined, by whom, what was obtained and on what decision.
Sotir Kllapi: All the expert reports for all the phones, not just the phone that the defendant refers to, are in file 62. In file 63 there are two inspection reports with all the data. There are two reports, not one. We did not know that this phone belonged to Mrs. Kryemadhi, because the phone was found in Fatime Kryemadhi's apartment. We will take a more complete position in the following sessions. As evidence, there is the number 348.
Mbrojtja: Nuk jemi njoftuar, ndryshe nga veprimet e tjera për të cilat jemi njoftuar dhe kemi firmosur. Nëse është marrë një vendim procedural, si në rastin kontabël apo për telefonin, duhet të ishte marrë një vendim që palët ta firmosnin. Monika Kryemadhi: Marrim një provë dhe del provë tjetër. E para, akuza është shumë seksiste sipas meje. Pretendon se Monika Kryemadhi në çdo aspekt bënte çfarë kërkonte bashkëshorti, ndërkohë unë kam bërë çfarë më ka dashur qejfi. Me Edi Ramën kam komunikime pa fund, madje edhe bisedat me Pirro Xhixhon i kam njëherësh me Edi Ramën. Organi i akuzës nuk ka denjuar ta marrë në pyetje Edi Ramën, ta pyeste nëse i ka shkuar Kryemadhi apo Meta dhe nëse i kanë kërkuar diçka për Adrian Shatkun. Pse qenka bashkëpunim Ilir Meta me Kryemadhin, kur nuk qenka Edi Rama me Aleksandër Meksin dhe Sali Berishën? Bashkëpunimi me Ilir Metën nuk është provë shkresore. Bashkëpunimi me Ilir Metën kanë qenë vetëm tre kalamajtë. Mesazhet me Edi Ramën kanë qenë biseda për AKEP-in me Kryemadhin. Pse nuk i merr SPAK mesazhet ku Rama i kërkonte Kryemadhit mbarëvajtjen e marrëveshjeve për Lezhën, Hipotekën, Vlorën? Pse nuk ka marrë Taulant Ballën? Mesazhet në adresë zyrtare me Engjëll Agaçin. Prandaj them se është një akuzë seksiste, që do të thotë se kam qenë e varur nga Ilir Meta. Por jo, kam qenë e pavarur.
Redi Llanaj, avokat i Kryemadhit: 3 herë SPAK tha se nuk ka korrupsion me biznesmenin për çështjen e banesës, por sqaroi se ka marrëdhënie korruptive. Marrëdhënia miqësore konsiderohet nga organi procedues marrëdhënie korruptive. Sqarojmë se të pandehurit e kanë pranuar edhe vetë që kanë miqësi, marrëdhënie njohjeje të hershme miqësore. Janë lënë disa detyra nga gjyqtari i seancës paraprake për moskoherencën e hetimit. Mendoj se nuk janë gabime, por paragjykime. Ligjërisht, kërkesa është shkruar nga 3 prokurorë; de facto është vetëm një prokuror, Altin Dumani. Drejtues ishte edhe Arben Kraja, por Arben Kraja është Arben Kraja, nuk u përdor si vegël.

This phone was taken, the data was extracted and those materials that are part of the proceedings were removed, taking the data out of context. We demand the absolute unusability of all data extracted from the President's phone. An examination should be conducted and a comparison made with the materials that were taken out of context.
Kryemadhi: I wanted to start with a preliminary request for the invalidity and unusability of the phone data. I filed a request, but they rejected my request for the return of the items and the phone. The judge rejected the request with the argument that the phone is not mine. The Appeals Court also rejected it.
And the prosecution claimed that it wasn't mine, because it was found in Fatime Kryemadhi's apartment. At the time the phone was examined, in 2023, I was a member of parliament and the prosecution couldn't come to inspect it.
The prosecution knew very well that we lived in the same house. I know very well that they searched my bedroom, even though it was Fatima's in the mortgage. These decisions state that the phone is not mine, while 190 pages of the indictment are based on these messages. If it is Fatime Kryemadhi's, let her come and clarify the messages with Vali Bizhge, Albana Shtylla, Engjëll Agaçi, etc.
