SPAK individual proceedings against "Bankers Petroleum" as a legal entity, the company cannot benefit from the fiscal peace law...
The Special Prosecution has blocked the possibility of fiscal amnesty for “Bankers Petroleum”. At the end of last year, the Parliament approved two draft laws: “On the cancellation, extinguishment and payment of tax liabilities to the central tax administration and of duties payable to customs” and “On the fiscal peace agreement”.
Under the first law, debts dating back more than a decade will be completely canceled. One of the companies that has numerous obligations to the state is “Bankers Petroleum”. It has customs duties and a fine worth 120 million euros, imposed for fiscal-customs fraud. It has also been rumored to be the biggest beneficiary of this scheme.
But SPAK seems to have blocked any kind of bargain. In the transparency program, SPAK was asked whether it had registered criminal proceedings against the legal entity “Bankers Petroleum” as a taxpayer with NIPT L43128401L, due to the fact that the fiscal peace law does not allow companies under investigation to benefit. SPAK confirmed that it had registered individual criminal proceedings against “Bankers” as a legal entity, before the law came into force.
" The Special Prosecution Office has registered criminal proceedings against the entity 'Bankers Petroleum', suspected of committing the following criminal offenses: 'Hiding income', 'Creating fraudulent schemes related to value added tax', provided for by articles 180/3 and 144/a of the Criminal Code ", SPAK emphasizes.
According to the law, if the company is being criminally investigated for tax offenses such as fraud and/or evasion, or has a final conviction for concealing income or money laundering, it is immediately disqualified. These are precisely the two offenses for which SPAK has registered criminal proceedings. This means that “Bankers” cannot enter into a fiscal agreement with the Tax Authorities.
So it seems that SPAK has burned any kind of bargain that may have been going on behind the scenes. " Pamphlet " reported before the fiscal peace was approved that, in early November 2025, Fier Customs resent the notice to the "Bankers" company for the payment of the obligation by December 22, but there were maneuvers by the government to enter into bargains due to the law in question. However, SPAK has preceded the situation. Today, "Bankers Petroleum" appears as a legal entity under investigation.
On the other hand, investigations have been deepened. SPAK has extended the investigation to Austria, as it turns out that “Bankers” used the headquarters of “Raiffeisen Bank” to carry out transfers. SPAK has sent a letter of request to Austria to obtain transaction data.
In addition, investigations are also being conducted against senior state officials in Albania. In addition to the two offenses above, SPAK is also investigating: “ Laundering of proceeds of crime or criminal activity”; “Abuse of office”; “Failure to perform duties by tax authorities”; “Passive corruption of senior state officials or local elected officials”; “Structured criminal group” and “Commitment of criminal offenses by criminal organization and structured criminal group ”.
On July 3, the Fier Prosecutor's Office raided the offices of "Bankers". By decision of the Fier Court, 14 security measures were issued. The file was then transferred to SPAK.
"Bankers Petroleum" is suspected of having fictitiously increased its expenses throughout its 20-year period of activity, in order to result in losses in its annual balance sheets. This scheme has enabled the company to avoid paying corporate income tax, while benefiting from unjustified VAT refunds, causing millions of lek in damage to the state budget. /Pamphlet
