Murder of Santiago Malko, SPAK seeks 157 years in prison for members of the Duka

SPAK has today filed a claim with the GJKKO regarding the murder of former police officer Santiago Malko, a crime that occurred in 2019 in Tirana. Members of the Duka clan, led by Leonard Duka, also known as "Prince Damian", have been charged with this murder. In total, SPAK has requested 157 years in prison for the members of the group who were tried for the murder of former police officer Malko.

For Leonard Duka, SPAK has requested a sentence of 32 years in prison. SPAK has also requested the same sentence for Fatmir Hyseni, while for Erlis Duka, Leonard's brother, a sentence of 25 years in prison was requested.

Meanwhile, SPAK has requested a sentence of 23 years in prison for Oltian Logan and Dritan Agaj, while a sentence of 22 years in prison was requested for Aleksandër Manjxaku.

For the murder of former police officer Malko Blendi Teta was sentenced to 25 years in prison, while according to SPAK he informed the perpetrators about the victim's movement.

The defendants are accused of "Premeditated Murder", "Unlicensed Weapons Possession" and "Drug Trafficking", crimes committed within the framework of a structured criminal group.

Tensions in the session

The hearings where Leonard Duka and other members of his group were tried were characterized by tensions and clashes.

In several hearings, Leonard Duka clashed with SPAK prosecutor Behar Dibra, whom he accused of manipulating the file.

But there were also tensions in cases where the sessions were attended by the victim's mother.

"I remember, on the day of the incident, I was escorted by the police, they took my fingerprints, then they let me go. That's where I learned about the incident. I was in my bar until 10 o'clock, after I closed the bar, the police stopped me as I was leaving for home. Like every day with work, we had lunch with the staff and then I continued on my way.

I was with my brother, Erlis Duka, the police signaled me and we went to the police. The police did their job in the most humane way, no objections to the way they escorted me, they took me out the next day. I didn't know who had died, I found out there. They asked me, I told them I had nothing to do with the incident, I told them about my old acquaintance and friendship with the deceased. After they corruptly arranged the papers, they declared me wanted. Can you tell me, prosecutor, why I am here, because I don't know", was one of the testimonies in Leonard Duka's courtroom.

He was asked how he knew the victim, and he stated that "they had common company."

"Albania is small. I have not had close friendships with it. We are from an area here in Tirana. I am involved in the lottery," said the Duke.

When did the crime occur?

At that time, the State Police stated that they had declared citizens Leonard Duka, Orion Loga, Dritan Agai, Erlis Duka, Ilir Selmani, Aleksander Maxhaku, Xhoni Nica, (all seven residents of Tirana) and Fatmir Hyseni, (M.,) resident of Vlora, wanted.

Against them, initially it was the Tirana Judicial District Court that imposed the security measures of "prison arrest" and then the file was transferred to the GJKKO and SPAK.

"During the procedural actions, the investigative group managed to find and seize as material evidence 8 vehicles, including the vehicles used by the perpetrators to commit the crime, as well as the items found inside them.

"The investigation group continues to work intensively to fully document the legal circumstances of the incident and other possible persons involved in it, as well as to locate and capture the above-mentioned persons who are already wanted," the Police announced. /Pamphlet/
