While dozens of cases for abuse of office are closed with verdicts, the trial against Fatmir Mediu has been languishing for years between postponements, fueling suspicions of another bailout procedure...

During the period January 2025 - March 2026 alone, SPAK and the Special Court have finalized 32 first-instance court proceedings for the criminal offense of "abuse of office" committed by state officials.

Meanwhile, the trial against former Defense Minister Fatmir Mediu, with two identical criminal charges in the "Gërdeci" case; abuse of office and abuse of office as a minister, in collaboration with a commanding military entity, is dragging on and there is no sign of when it might end.

During the 5 years since the start of the process, 48 ​​court hearings have been postponed against Fatmir Mediu, for his role in establishing the ammunition dismantling factory in Gërdec and for his responsibility for the lack of control over the dismantling conditions, which led to the tragic explosion that killed 26 people and caused extensive damage to homes and businesses.

The technical trial of the human and economic consequences of the explosion concluded on March 12, 2012, convicting several people. Among them, administrator Mihal Delijorgji was sentenced to 6.7 years in prison, but was quickly released due to the time he had served in pre-trial detention.

While former minister Fatmir Mediu escaped trial by dismissing the case, after Sali Berisha, through a maneuver of removing and restoring immunity, made him an MP and Minister of the Environment again.

At the same time, the General Prosecutor's Office dragged out the investigations until September 2009, when Mediu was granted parliamentary immunity and the case was procedurally dismissed.

The process against Fatmir Mediu resumed as a re-investigation in January 2021, but SPAK, in violation of the deadlines of the Criminal Procedure Code, sent the file for trial only in February 2023, when the first court hearing took place.

The delay in the investigation by SPAK was compounded by the delay in the trial by the Special Court, in cooperation with SPAK, experts and the defendant's lawyers. As a judicial process alone, the case has been dragging on for 4 years.

The hearings are being postponed every two weeks, for various reasons: absence of prosecutors or judges due to "work commitments", absence of Fatmir Mediu due to "official visits" to the US, absence of lawyers, experts or witnesses due to health reasons, as well as reformulations of the indictment or other procedural maneuvers.

For 5 years, the actions of SPAK and the Special Court, in cooperation with the parties involved in this process, resemble a continuous rotation around the same point: postponing hearings to lead to another procedural closure of the case.

It is absurd and even scandalous for the new judiciary that a process for "abuse of office" should last so long, without any clear deadline for completion, while postponements continue every two weeks with various excuses.

The abuse of office in the Gerdec case has been proven for 18 years with official documents, filed in the files of the Ministry of Defense, in the law on the minister's competencies and in official communications, including meetings with Shkelzen Berisha.

However, even the institutions that today hold the "hammer" of the new justice system seem to have become part of this delaying mechanism. Meanwhile, the High Judicial Council, the High Prosecutorial Council and the High Inspectorate of Justice have not undertaken any administrative investigation against the prosecutors and judges involved./ Pamphlet
