The US Congress has concluded that the state of democracy in the Western Balkans presents serious concerns, while the conditions under which elections are held in some countries in the region are considered unfair. These assessments are part of the Western Balkans Democracy and Prosperity Act, which was approved last week by the US House of Representatives.
The act is part of the National Defense Authorization Act ( NDAA ) for Fiscal Year 2026 which was approved by 312 votes in favor and 112 against and signed by President Donald Trump.
Unlike previous declaratory resolutions, this act creates a binding legal framework, making its provisions applicable to the US State Department and the Pentagon, as well as clearly defining US policy towards the Western Balkans.
The legislation defines the Western Balkans as a region essential for peace, stability and prosperity in Europe, but at the same time emphasizes that corruption, including at high political levels, as well as disinformation campaigns, pose serious threats that undermine democratic institutions and electoral integrity.
In this context, the region is identified as a space where corruption and disinformation spread in political environments characterized by autocratic control or deep party conflict, constituting a major obstacle to economic and political development.
One of the key provisions of the act is the imposition of sanctions. The US President requires that, within 90 days of the law's entry into force, punitive measures be taken against any foreign individual involved in corruption related to the Western Balkans.
Sanctions are also foreseen for individuals or policies that threaten the peace, security, stability, democratic processes or territorial integrity of countries in the region, as well as for serious human rights violations. Measures may include asset freezes and visa revocations.
At the same time, the U.S. Secretary of State is mandated to strengthen the Anti-Corruption Initiative, through existing and new programs, including technical assistance, training, and sharing of best practices with law enforcement agencies, judicial institutions, and relevant bodies, with a particular focus on combating political corruption and preserving electoral integrity.
What was found by the American Congress:
(1) Vendet e Ballkanit Perëndimor (Republika e Shqipërisë, Bosnje dhe Hercegovina, Republika e Kosovës, Mali i Zi, Republika e Maqedonisë së Veriut dhe Republika e Serbisë) përbëjnë një rajon pluralist dhe shumëetnik në zemër të Europës, i cili është thelbësor për paqen, stabilitetin dhe prosperitetin e këtij kontinenti.
(2) Paqja, stabiliteti dhe prosperiteti i vazhdueshëm në Ballkanin Perëndimor janë të lidhura drejtpërdrejt me mundësitë për përparim demokratik dhe ekonomik që u ofrohen qytetarëve dhe banorëve të këtyre gjashtë vendeve.
(3) Është në interes të përbashkët të Shteteve të Bashkuara dhe vendeve të Ballkanit Perëndimor të promovojnë rritje dhe zhvillim ekonomik të qëndrueshëm dhe të stabilizuar në rajon.
(4) Reformat dhe procesi i integrimit në Bashkimin Europian, të ndjekura nga vendet e Ballkanit Perëndimor, kanë çuar në përparim të ndjeshëm demokratik dhe ekonomik në rajon.
(5) Pavarësisht progresit ekonomik, normat e varfërisë dhe papunësisë në Ballkanin Perëndimor mbeten më të larta sesa në vendet fqinje të Bashkimit Europian.
(6) Emigrimi masiv, veçanërisht i të rinjve, po ndikon ndjeshëm në strukturën demografike të çdo vendi të Ballkanit Perëndimor, duke sjellë rënie të popullsisë në të gjashtë vendet.
(7) Zbatimi i reformave kyçe ekonomike dhe të qeverisjes mund të ndihmojë në krijimin e mundësive për investime dhe punësim në Ballkanin Perëndimor, veçanërisht për të rinjtë, si dhe të sigurojë mjete të fuqishme për zhvillim ekonomik dhe për nxitjen e pjesëmarrjes më të gjerë në proceset politike që rrisin mirëqenien për të gjithë.
(8) Përpjekjet ekzistuese për bashkëpunim ekonomik rajonal, si Tregu i Përbashkët Rajonal, Procesi i Berlinit dhe Nisma “Open Balkan”, kanë potencialin të përmirësojnë kushtet ekonomike në Ballkanin Perëndimor, duke promovuar njëkohësisht përfshirjen dhe transparencën.
(9) Departamenti i Tregtisë i Shteteve të Bashkuara, përmes Shërbimit të tij Tregtar të Jashtëm, luan një rol të rëndësishëm në promovimin dhe lehtësimin e mundësive për investime amerikane.
(10) Korrupsioni, përfshirë edhe ndër liderët kryesorë politikë, vazhdon të dëmtojë rëndë Ballkanin Perëndimor dhe përfaqëson një nga pengesat më të mëdha për zhvillimin e mëtejshëm ekonomik dhe politik të rajonit.
(11) Fushatat e dezinformimit që synojnë Ballkanin Perëndimor minojnë besueshmërinë e institucioneve demokratike të rajonit, përfshirë integritetin e proceseve zgjedhore.
(12) Cenueshmëria ndaj sulmeve kibernetike ose ndaj infrastrukturës së teknologjisë së informacionit dhe komunikimit rrit rreziqet për funksionimin e qeverive dhe ofrimin e shërbimeve publike.
(13) Komanda Kibernetike e Shteteve të Bashkuara, Departamenti i Shtetit dhe agjenci të tjera federale luajnë një rol kritik në mbrojtjen e interesave të sigurisë kombëtare të SHBA-së, përfshirë edhe përmes dislokimit të ekipeve kibernetike “hunt forward”, me kërkesë të vendeve partnere, për të forcuar mbrojtjen e tyre kibernetike.
(14) Securing cyber networks and information and communications technology infrastructure, both domestically and internationally, is a national security priority for the United States, which is reflected in the numerous government offices and programs that support cybersecurity.
(15) Corruption and disinformation spread more easily in political environments characterized by autocratic control or pronounced partisan conflict.
(16) The dependence of the Western Balkan countries on Russian sources of fossil fuels and natural gas ties their economies and policies to the Russian Federation and hinders their aspirations for European integration.
(17) Reducing the Western Balkans' dependence on Russian supplies of natural gas and fossil fuels is in the national interest of the United States.
