
The next hearing on the Partizani file will take place on September 15. This was decided during today's hearing, where the lawyers of Democratic Party leader Sali Berisha, as well as the latter's son-in-law, Jamarbër Malltezi, requested the exclusion of the judging panel, even though the former Prime Minister previously stated that there are no disputes regarding its composition.
But at the hearing, Berisha's lawyers and his son-in-law, Malltezi, raised claims that they be tried by an independent body.
"Let us be tried by a panel outside this court, since it has already been proven that they are not independent, they are blackmailable by SPAK and BKH," said Malltezi, a request that was also presented to the panel by the lawyers of the democratic leader, Berisha.
"We demand to be tried by an impartial court. The judges of the Special Court are controlled by SPAK. The judges of the GJKKO are under constant supervision, which does not meet the conditions of the independence of this court. This supervision of the court by a party to the process violates the principle of an independent court.
"We demand the exclusion of all judges of the Special Court from this case, as we do not meet the criteria of impartiality, and the case be sent for trial to judges who are not controlled by SPAK and BKH. To be tried by judges outside this court," said Gjokutaj.
Meanwhile, SPAK prosecutor Arben Kraja said that the Constitutional Court has given its answer to the matter in question. "This matter has taken a direction and the Constitutional Court has expressed itself once regarding such requests," said Kraja, responding to the request of Berisha's lawyers and his son-in-law, Malltezi.
Earlier, speaking from the doors of SPAK, former Prime Minister Sali Berisha said that he had no claims regarding the composition of the judging panel, and even claimed that there are no disputes over specific names.
Berisha and Malltezi are two of the 5 defendants in what is considered an affair with the privatization of the former Partizani complex. The file has already been sent to trial at the GJKKO after 7 months of delay, while this is the preliminary phase, where the parties in the process present their requests, including those for changes to the judging panel.
