Former Prime Minister Sali Berisha, one of the defendants in the 'Partizani' case that has gone to trial at the GJKKO, appears to have had a clash with his lawyer Genc Gjokutaj, regarding the composition of the trial panel.

The Partizani case will be judged by 3 judges Elsa Ulluri, Rudina Palloi and Bib Ndreca. Asked if there are any disputes regarding the names, Berisha said that there are no disputes. "I am aware of Monday's session and I declare that they will not appear. I want to be represented by lawyers Genci Gjokutaj and Klodina Gjyzari. I will appear whenever necessary and when I think it is reasonable that I should be present," Berisha said.

While the former Prime Minister declared that there was no dispute regarding the composition of the judicial panel, his lawyer Genc Gjokutaj filed a request with the GJKKO to disqualify the entire panel.

Gjokutaj's reaction came after the head of the body, Elsa Ulliri, reported that the president of the GJKKO has decided not to accept the judge's resignation.

"We demand to be tried by an impartial court. The judges of the Special Court are controlled by SPAK. The judges of the Special Court are under constant supervision, which does not meet the conditions of the independence of this court. This supervision of the court by a party to the process violates the principle of an independent court," said Gjokutaj.

Requests for changes to the panel of judges are a procedure that is often followed by lawyers during criminal trials, and which aim to delay or postpone the start of the trial or the normal continuation of the hearings. 

The Partizani affair case went to trial on May 19. It took the court a full 7 months to make a decision on whether or not to proceed with the case, where in addition to Berisha, his son-in-law, Jamarbër Malltezi, is also a defendant.

None of the defendants have requested a summary trial, which means it will be a long process. Berisha will be tried on charges of passive corruption of high-ranking officials, as he is accused of having, in his capacity as prime minister, taken concrete actions in approving laws and by-laws, where his son-in-law, Jamarbër Malltezi, was also a beneficiary.

Malltezi is accused of passive corruption and money laundering. According to SPAK, he has illegally benefited from a construction business worth 5.4 million euros thanks to government decisions taken by his father-in-law.

Fatmir Bektashi is accused of corruption and money laundering, Malltez's partner and land heir Xhimi Begeja, and financier Andia Pustina, who handled the financial and legal affairs of the company "Homeplan", are accused of money laundering. In addition, three companies "Kontakt", "Homeplan" and "Studio Pustina" have also been sent to trial for money laundering. /Pamphlet/
