The Constitutional Court of Kosovo has rejected the request of the Speaker of the Assembly, Albulena Haxhiu, and nine other deputies, who sought an assessment of the constitutionality of the procedure for electing the President, after the failure of the March 5 session due to lack of quorum.
With a unanimous decision, the Court not only dismissed the applicants' request, but also rejected the request for the imposition of a temporary measure aimed at suspending the constitutional deadline for the election of the head of state.
In her decision, the Constitutional Court clearly determined that the request is unfounded, while also ordering that the decision be communicated to the parties and published in the Official Gazette, and enter into force immediately.
The request was filed by Haxhiu one day after the parliamentary session for the election of the President was adjourned, where the absence of the opposition meant that there were only 66 MPs in the hall, an insufficient number for the vote to continue.
At that moment, the Speaker and supporting MPs claimed that the opposition's non-participation constituted a constitutional violation, requesting interpretation from the Court and at the same time the suspension of the deadlines until a final decision.
But with its decision, the Constitutional Court did not uphold this argument, leaving the existing deadlines in force and paving the way for the continuation of the procedures for electing the President without any change to the constitutional calendar.
This development brings the issue back to the Assembly, where it still remains unclear whether the necessary quorum will be secured to move the process forward, in a tense political climate with strong clashes between the majority and the opposition.
