ILD leader Artur Medani has commented on Rama's political attacks on judges regarding the decisions they make. He said that the judiciary has recently been put under unconstitutional pressure.
The statement was made during a meeting organized by the High Inspector of Justice, in collaboration with the Matra project of the government of the Kingdom of the Netherlands, where the head of SPAK Altin Dumani was also present.
"It's been a while since the judicial system has been under pressure, which I consider unconstitutional, to exercise its duties or not, in a certain way. From everyone. It's been a long time since insults to magistrates have been a significant part of the articulation when it comes to criticism of the judicial power. Of course, these are unacceptable in every respect. This puts magistrates to a difficult test. But the test of independence, of the separation of powers and the rule of law is not just rhetoric," Metani says.
Metanin added that self-restraint and distancing from public statements are needed. The head of the ILD explains that a direct response to these reactions is not the job of any judge and that the lack of reaction is not weakness on their part, but self-restraint.
"Unlike other powers or institutions, magistrates and independent justice institutions have a kind of limitation, which comes with the duty to show restraint, even when they are unjustly attacked. Among strong public voices, this makes them perceived as weak, but this is not the case at all. Restraint should not be confused with weakness. Despite the statements of various public actors, magistrates should not forget that public reactions are not part of their function. But, restraint is! Restraint is not a weakness of any kind, but respect for freedom of expression in a democracy, it is a constitutional distance from the political nature of other powers," he added.
