Arben Ahmetaj has scored an important victory in his legal battle with SPAK. The High Court has decided to overturn the decision to seize part of the former deputy prime minister's assets and return the case for retrial to the Special Court of Appeals.
The decision was made by Judge Gent Shala, who overturned the previous decision of the Special Appeal, partially granting Ahmetaj's request. With this decision, the High Court assessed that the case should be reviewed again by another judicial body, overturning at this stage the position previously held by SPAK, the First Instance and the Special Appeal.
This concerns the seizure of some of Ahmetaj's assets, for which SPAK had argued that there was a risk of alienation due to the property investigation against the former number two in the government. However, the recent decision of the Supreme Court has opened a new chapter in this process, returning the file to the Appeals Court for a full reassessment.
Ahmetaj's request to the High Court came after the Appeal of the GJKKO had upheld the First Instance decision on the seizure of assets. Now, with the intervention of the High Court, the two previous decisions have been overturned and the case will be reviewed by another judicial body.
SPAK has seized a total of six assets linked to Ahmetaj, including four apartments and two bank accounts worth around 124 thousand euros. However, the latest decision of the Supreme Court is considered an important development for the protection of the former deputy prime minister, as for the first time a higher court has overturned decisions taken earlier in this process.
The retrial in the Special Appeal is now expected to determine the fate of the asset seizure, while the legal battle between Ahmetaj and SPAK continues in parallel with the investigations being conducted against him within the incinerators file.
