The court found that the detention period had been exceeded and ordered the immediate release of Ilir Selmani from the cell.
The Special Court of Appeal for Corruption and Organized Crime has changed the security measure for Ilir Selmani, accused of being one of the perpetrators of the murder of former police officer Santiago Malko, an event that occurred in August 2019 in Tirana.
With the decision announced this Friday, June 19, 2026, the Appeals Court of Kosovo accepted Selman's request and determined the loss of force of the security measure "Arrest in prison", due to the expiration of the legal detention deadlines.
As a result, the court decided to replace it with the measure "House Arrest", ordering that the defendant not leave his apartment in Tirana.
The decision also provides for Selman's immediate release from detention and his escort to his apartment for the execution of the new security measure.
According to the SPAK file, Ilir Selmani is part of Leonard Duka's criminal group, accused of a series of serious criminal events.
The "Duka Clan" was accused of the assassination and the motive was suspected to be revenge for a rape that the former police officer had committed against the father of the two Duka brothers. SPAK had at least 13 people involved in the organization and finalization of the murder as defendants and investigators, a large part of whom have already been convicted.
"The prosecutor and the judicial police are ordered to execute this decision through continuous surveillance of the defendant IS's residence. The defendant IS's immediate release and his escort to the residence are ordered ," the Appeals decision states.

DECIDED:
Acceptance of the request, ascertaining the loss of the power of detention for the defendant Ilir Selmani related to the security measure "Arrest in prison", determined by decision no. 145, dated 10.10.2019 of the Court of First Instance for Serious Crimes, Tirana, verified by decision no. 43, dated 17.04.2020 of the Special Court of First Instance for Corruption and Organized Crime.
The imposition of the security measure "House arrest", provided for by Article 237 of the Code of Criminal Procedure, against the defendant Ilir Selmani, ordering him not to leave his apartment in Tirana.
The prosecutor and the judicial police are ordered to execute this decision by continuously monitoring the residence of the defendant IS.
The immediate release of the defendant IS is ordered and his escort to the apartment for the execution of the security measure "House Arrest".
This decision may be appealed to the Supreme Court within 45 days from the day after the decision is announced.

Ilir Selmani's role in the murder of Santiago Malko
Ilir Selmani turns out to have been part of the 'Duka' clan, also known as the Roma gang, for several years. The murder of Santiago Malko
Former police officer Santiago Malko was executed on the evening of August 27 in the “Xhamlliku” area of Tirana, in his “BMW X5” car. Malko also owned several sports betting points. He was involved in the October 4, 2018 incident, where Fabian Gaxha was killed in the former Bllok after a gunfight. The murdered former police officer was also involved in a fight with the two Lashi brothers in 2016 over a debt of 1,000 euros.
After this serious event, it was discovered that Santiago Malko was part of the Environment and Forestry Inspectorate, where he worked as an inspector even though he was wanted.
