The High Court has left in force the security measure of "prison arrest" for the Mayor of Tirana, Erion Veliaj.
The Supreme Court's decision follows a series of requests that the Mayor has made to change the security measure.
The Supreme Court, with today's decision, has upheld the Appeals Court's decision, according to which Mayor Erion Veliaj must remain in prison.
The panel of judges, composed of Albana Boksi, Sokol Binaj and Genti Shala, decided to uphold the February 24 decision of the Appeals Court of Kosovo. Veliaj had requested the replacement of the “prison arrest” measure with another alternative measure to the property guarantee, or a mandatory appearance measure, but the Appeals Court rejected his request.
The Mayor's appeal was filed with the Court, two days after the Joint Panel of the Supreme Court made the unifying decision on security measures, where it is up to the Prosecution to argue why it is requesting security measures of "prison arrest", when it is possible to apply other security measures.
In addition to this recourse, the Constitutional Court has returned another request for Veliaj's freedom to the High Court. According to the Constitutional Court, the High Court, in the decision it will have to retry for Veliaj, will have to justify whether the measure of "prison arrest" is proportional in relation to Veliaj's position as mayor. It is expected that the High Court will reconsider the request for changing the security measure, but with a different panel of judges.
Veliaj was arrested in February 2025 by order of SPAK, while the Special Prosecution Office filed 13 charges against him, 9 of which related to corruption and money laundering.
His wife, Ajola Xoxa, is also accused by SPAK of passive corruption in 9 cases, related to commercial entities and non-profit organizations, the same as Erion Veliaj. Xoxa is also accused of money laundering, failure to declare assets and concealment of income.
