The taking of statements by the police in the form of psychological pressure from a person who does not know how to read and write has become one of the main causes of the overturning of the conviction decision for the 4 defendants in the criminal case, which concerns the murder of Martin Çeço.
The decision of the Tirana Court of Appeal, to overturn the decision of the Korça Court that sentenced the 4 defendants Valter Mollaj, Edlir Mollaj, Martina Pajollari and Blendi Angjo to 83 years in prison, was taken two days ago.
While the file will now be subject to a retrial procedure with a different panel of judges. One of the main arguments that the Tirana Court of Appeal overturned the sentence given by the Korça court for the 4 defendants was the fact that Blendi Angjo, who worked as a shepherd for Valter Mollaj, cannot read or write.
According to the court, the Korça police committed actions not in accordance with criminal procedure against this witness, whom they then charged with "Premeditated Murder" committed in collaboration.
Questioning a person who cannot read or write without the presence of a lawyer of his choice or a family member has been deemed a serious procedural violation, and the process has been ordered to be retried.
At the same time, the Appeal has also raised problems regarding the claims raised by the lawyers, as the witness Martina Pajollari, who later ended up as a defendant in this case, was questioned under psychological pressure./ OraNews
