
With 1 million euros for a 700-page report, the majority warns of legal intervention to "reform" the new justice system. The silent objective: the capture or dissolution of SPAK...
At a press conference, Fatmir Xhafaj declared the closure of the parliamentary committee "On Good Governance, Anti-Corruption and the Rule of Law", but openly confirmed that the majority has not given up on its intention to exert pressure and control over SPAK and the new justice institutions.
According to Xhafaj, the commission he led has identified worrying problems in the status, independence, obligations, and legal and practical functioning of the special anti-corruption structure, which it will address to parliament to intervene in the law.
But for the competences and independence of SPAK, the only reference is the Constitution, which has a special annex for this structure. Xhafaj's statement shows that the majority aims to change this framework, not to strengthen SPAK, but to weaken, capture or dissolve it, with the justification that its mission has been fulfilled.
The anti-SPAK “Xhafaj” report has 700 pages and the cost of its drafting is 1 million euros, about 1430 euros per page. Of this amount, 500 thousand euros were paid for experts appointed by Xhafaj himself and 500 thousand euros for other expenses: assistance, materials, honoraria, etc.
But beyond the numbers, the most serious concern is Xhafaj's statement that although the commission was closed, the majority's plan to put SPAK under control continues. The report will be discussed at the beginning of the new legislature, with the aim of drafting laws aimed at reforming the justice system.
Regarding the extension of the mandate of SPAK, Xhafaj stated that there is no need or argument for doing so. On the contrary, the commission has proposed the establishment of a permanent parliamentary decision-making commission that will oversee the activities of the new judiciary.
This intervention, according to Xhafaj, is necessary to strengthen the fight against corruption. But in fact, what is expected is the release of the brakes on SPAK and the restoration of political control over justice. If SPAK has violated the law, this is also part of the problem, as is the case of Xhafaj's brother, removed from the OFL list, and the assets of his family members that have not been investigated.
Thus, with a luxurious report and a coded agenda, the majority is preparing the ground to close one chapter and write another, with a justice reformatted according to the needs of the government. SPAK has become a target, and the blow is being masked with words like "reform", "restructuring" and "efficiency". Meanwhile, the silence of other institutions remains the greatest concern./ Pamphlet
