SPAK sends Gjolek Guci to trial for the "red flag" tender, while the wiretaps and evidence of Mirela Kumbaro's interference remain outside the indictment...
The Special Prosecution Office has brought to trial the former mayor of Memaliaj and other officials for the 5 million euro water supply tender, awarded without competition and with almost 100% of the limit fund. But the BKH investigations, wiretaps and testimonies also speak of direct interference by Mirela Kumbaro in the allocation of funds, environmental permits and subcontracting of works. While the water supply is not even 20% completed, the minister's name does not appear in the indictment, raising questions about the selectivity of the investigation and the second phase of the criminal proceedings.
The Special Prosecution Office has sent the former Mayor of Memaliaj, Gjolek Guci, two of his subordinates and private entities for trial for the largest financial theft affair that was organized and carried out in that small municipality.
This is a tender with the object: "Construction of the Regional Water Supply for the villages of Vasjar, Iliras, Qesarat, Anë-Vjosë, Toç, Lulëzim, Zhulaj, Krahës and in the city of Memaliaj", financed by the State Budget, with the procurement and contracting authority being the Municipality of Memaliaj.
This tender had a limit fund of around 5 billion old lek including VAT, while the winning bid signed by Gjolek Guci was only 12 euros less than the limit fund, given without competition to the merger of the companies "KEG" sh.pk and "ED Konstruksion" sh.pk, the only participants in the tender.
In the report of the KLSH on October 28, 2024 and in Criminal Proceeding No. 216, dated November 4, 2024 by SPAK, the former mayor of Memaliaj, Gjolek Guci and his group were investigated for violating equality in tenders, pre-determination of the winning value and subcontracting the construction of the water supply to the company that had done the project for free.
But Mirela Kumbaro, MP, minister and political leader in the Gjirokastër District, known as the "Beyleresha" of power in the South, has also been implicated in the Memaliaj water supply affair.
During the investigation conducted by the BKH, also through wiretaps and testimonies of the prosecuted persons and company owners, the name of Minister Mirela Kumbaro emerged as an active person in the group involved in this tender affair.
She intervened and influenced Edi Rama to allocate funds outside of planning and with a value 30% higher than the real cost, as well as to issue an environmental permit with fictitious documents after the tender was held.
According to the investigations, Mirela Kumbaro ordered former mayor Gjolek Guci to award the tender without competition to the companies "KEG" sh.pk and "ED Konstruksion" sh.pk with almost 100% of the limit fund, allowed payments to be made by the Municipality without starting the works and intervened with the Public Procurement Commission to not investigate this "red flag" tender.
The investigation and evidence that BKH collected from implicated officials of the Memaliaj Municipality and the owners of the companies have revealed that Mirela Kumbaro ordered that the works be subcontracted to the company "Artreum Generation", the financier of her campaigns.
The company "Artreum Generation" is owned by the wife of Lorenc Bami from Nikla, the catapulted Director of Urban Planning at the Municipality of Tepelena, currently under investigation by SPAK along with Tërmet Peçi for corruption with land, construction permits, tenders and IPARD funds.
The start of works for the Memaliaj water supply was inaugurated on April 7, 2021, before the elections, by Edi Rama and Mirela Kumbaro; the tender was held on April 9, the contract was signed on June 14, 2021, while the water supply was supposed to be completed on April 8, 2023, but so far not even 20% of the works have been completed.
Referring to this investigative data, we are asking two questions:
· Did Mirela Kumbaro "eat" from the "tray" of the 5 million euro tender for the Memaliaj water supply that former mayor Gjolek Guci signed?
· Why is the name of Minister and MP Mirela Kumbaro not reflected in the investigative file prepared by the BKH, based on the wiretaps and evidence collected?
It may be in the second phase of the investigation, as on January 28, 2026, SPAK separated Proceeding No. 216 into another case with Criminal Proceeding 216/1, for investigation of other evidence.
Let's wait and see, because so far Mirela Kumbaro has not been criminally prosecuted for the affairs with beaches, permits for resorts in protected areas, EU funds with Ilir Beqaj, areas of Butrint Park for villa complexes, permitting the waste of Kurum, etc./ Pamphlet
