The European Union Office in Kosovo, QUINT countries and EULEX have sent a letter to Kosovo institutions, in which they request the adoption of secondary legislation to clarify the implementation of the legal framework regarding the use of community symbols and flags.

The letter, dated June 17, 2026, was addressed to the acting Minister of Local Government Administration, Elbert Krasniqi, and the acting Minister of Internal Affairs, Xhelal Sveçla, and was also forwarded to the Director of the Kosovo Police and all mayors.

The document was signed by the Acting Head of the EU Office in Kosovo, Eva Palatova, the Ambassador of France Olivier Guerot, the Ambassador of Germany Rainer Rudolph, the Ambassador of Italy Maurizio Antonini, the Ambassador of the United Kingdom Jonathan Hargreaves, the Chargé d'Affaires of the US Embassy Anu Prattipati, and the Head of EULEX Giovanni Pietro Barbano.

The letter states that the Constitution and legislation of Kosovo protect the right of all communities to preserve, express and develop their identity, including through the use and display of community symbols.

According to the signatories, the use of symbols, including national or community flags, is a right protected by the Constitution and the Kosovo authorities have the obligation not only not to interfere with the exercise of this right, but also to create the conditions for its equal implementation.

However, the paper assesses that the current legal framework remains incomplete, as the secondary legislation provided for by the Law on the Use of State Symbols has not yet been adopted.

According to them, the lack of these bylaws creates legal uncertainty and increases the risk of uneven or discriminatory implementation in practice.

For this reason, the EU, QUINT and EULEX call on Kosovo institutions to adopt, as a matter of priority, the necessary secondary legislation to ensure legal clarity and consistent implementation throughout the country.

They also demand that this process be conducted in close consultation with non-majority communities and in coordination with international partners.

The letter emphasizes that, until the adoption of the necessary acts, all issues related to the use of flags and symbols of communities, including during holidays and anniversaries, must be handled in accordance with the Constitution and applicable laws, in a consistent, proportional and non-discriminatory manner.
