Ilirjan Celibashi has dismissed the mayor of Kuçova, Kreshnik Hajdari, who was finally sentenced by a final decision in July 2024 to 6 months in prison for falsifying the decriminalization form, converted to probation.
According to the head of the CEC, Hajdari is not in the conditions for being banned from exercising his duties, as he served his sentence with community service.
"The CEC fulfilled its obligations arising from the review of this issue, requesting from the Special Prosecutor's Office the documentation that the KAS ordered. It is clear that that documentation is known to everyone and there is no additional documentation. We have received all the decisions of every institution on this issue: the CEC, the KAS, the Electoral College, the court and the Special Court. What is my assessment?
We are faced with the fact that he has submitted the decriminalization form. At the instigation of the DP, there has been a criminal review process. There is a criminal decision on this matter, which has sanctioned him with that punishment and, in the end, has ordered that that punishment be paid off with hours of community service.
The application of Article 63, does it decide whether or not to be in the conditions of detention? We have had a position on a similar case, but in my judgment, according to the interpretation I have of the law, I think that we are not in the conditions of detention for this subject. This is a position that I have held before and I am convinced of this interpretation.
If Article 63 is applied to someone, the punishment is non-existent. A non-existent thing is zero, it is an empty community. Beyond the discussion that can be made about morality, the legal fact remains what I said: this subject is not in the conditions of detention. This position has been previously confirmed by the KAS and the Electoral College in the Mallakastra case. For the reasons I listed, the mayor of Kuçovë is not in the conditions of detention", said Celibashi.
