This is a legal paradox and a moral contradiction that renders any claim to equality before the law invalid. How can one speak of institutional cooperation and mutual respect when a lawyer is prosecuted simply for exercising his constitutional duty, defending his client, analyzing and refuting evidence?

After several days of tension and strong reactions from the legal community, the Elbasan Prosecutor's Office has issued an official statement regarding the detention of lawyer Uljan Bajrami.

In this statement, the prosecution admits that the detention was illegal, ordering his immediate release. Up to this point, any action could be seen as institutional correction, a belated but fair reflection.

However, at the same time, the same prosecutor declares that it has registered a criminal proceeding against the same lawyer for the criminal offenses of "Threat due to duty, Threatening a judge, and Opposing and striking a judge."

This is a legal paradox and a moral contradiction that renders any claim to equality before the law invalid. How can one speak of institutional cooperation and mutual respect when a lawyer is prosecuted simply for exercising his constitutional duty, defending his client, analyzing and refuting evidence?

If every objection to evidence, every procedural debate, or every critical tone in the courtroom can be interpreted as "intimidation" or "objection to the judge," then we no longer have due process of law, but fearful trials.

A justice system that punishes the word of a lawyer punishes the very spirit of legal freedom on which the justice system is built.

In its statement, the prosecution tries to convey the message of cooperation and respect for institutions.

But when concrete actions contradict this spirit, their phrase about "mutual respect and professional integrity" remains a communication facade, which does not cover the bitter reality of an unjust detention and prosecution.

There can be no equal justice when one side, the prosecution, enjoys the power to stop and prosecute, while the other side, the defense, must be protected from the very abuses of this power.

This is not a professional draw, it is the asymmetry of power that endangers the essence of justice.

The lawyer is not a personal opponent of the prosecutor, but the legal guarantee that the judicial process is fair, transparent and balanced.

If the prosecution sees the lawyer as a threat, then the balance of the system is lost.

Indeed, prosecutors and lawyers are two pillars that keep justice afloat.

One after the other falls, and with them the trust of the citizen falls. If the citizen sees that a lawyer can be detained, bullied, or prosecuted just for speaking out, then every citizen understands that no one is protected.
