The Joint Panels of the Supreme Court met today, summoned by President Sokol Sadushi, to review the 2011 unifying decision on the measure of securing arrest in prison and its duration. The meeting of judges comes at a time when a debate has been taking place for months about the high number of pre-trial detentions in the country and a penal policy that many see as repressive, not applying alternative decisions to keeping defendants in prison.

Lawyer Kreshnik Spahiu, in a live broadcast for the show 'Frontline', commented on the criticisms of the Democratic Party leader Sali Berisha towards the Supreme Court and its head, Sokol Sadushi, regarding this issue.

"The judge comes out with the decision that those who are in detention without a final decision, should be released. Dozens of drug lords, heads of criminal organizations, benefit from this decision," Berisha declared, among other things, earlier today, after the meeting of the Joint Colleges of the Supreme Court.

Spahiu said that Berisha is in a conflict of interest, as he is a defendant and, according to him, it is not moral for him to come out and analyze the work of a judge.

"Berisha is in a conflict of interest. A defendant cannot come out publicly and analyze the judge. This issue is completely outside political and legal morality," Spahiu said, among other things.

Spahiu further said that in Albania, the detention cells are mainly the poor and those he described as 'pickpockets'. While those he described as 'pickpockets of the state', according to Spahiu, remain free.

Spahiu added that in Albania there are many criminal offenses that are unpunished, among which he mentioned tax evasion (which, according to him, is severely punished in European countries).

"Second, a practice opened by the Supreme Court, I also think that although it may be timely, I do not think it will bring any benefit, as it would be a precision and an amendment to the criminal procedure code. Given that we have judges who are very aggressive in unreasonable measures, then it would be good for the legislator to have the political will for more qualified, specified changes, to close any kind of expanded interpretation by the judge. It is true that prisons and detention centers in Albania are filled with the poor. This means that all the pickpockets in Albania are in prison and all the state's pickpockets are free. What does this mean? There are some criminal offenses in Albania that are unpunished, such as tax evasion,"  Spahiu added.
