The majority's recent proposals for intervention in the justice system have opened a strong debate in the Institutional Oversight Committee, where not only the effectiveness of these changes was questioned, but also the lack of an in-depth analysis of the current problems of the system.
One of the proposals that has sparked the most debate is that of the Union of Judges to postpone the retirement age for magistrates to 75, as an attempt to alleviate the crisis of the shortage of judges. “ Unfortunately, this issue has already gone into emergency mode ,” said Olsi Komiçi, justifying it as a temporary measure to curb the backlog of files in the courts.
But the chairman of the Commission, Fatmir Xhafaj, a former justice minister and the leader of the justice reform, sharply criticized the current government approach, stressing that changes cannot be made in a piecemeal manner. “ There is no bigger problem than this, but do these legal interventions solve it? ” Xhafaj asked, emphasizing the lack of a 10-year analysis of the real effects of the reform.
Xhafaj also raised concerns about the exclusionary interventions, which according to him do not address the underlying problem. " What happened? The Supreme Court and the Constitutional Court have not done their job and we intervene with ad hoc solutions for the leaders of the institutions. What if it happens again? ", he warned.
The debate also touched on the composition of the High Judicial and Prosecutorial Councils, where it was proposed to strengthen the filters on the wealth and connections of non-magistrate members. " We introduced representatives from the legal profession, academia and civil society to bring civic interest. Does this intervention guarantee professionalism? ", added Xhafaj.
