
KAS has today rejected the appeal of the leader of 'Albania Becomes', Adriatik Lapaj, who is persistently seeking to obtain the mandate of MP, insisting on the recognition of the acts of resignations by the candidates on the closed list of the 'Albania Becomes' coalition initiative.
In its decision, the KAS also partially overturned the CEC's decision, which passed the mandate to Kleana Xhuveli, but according to the Complaints and Sanctions Commission, the seat in Parliament belongs to Ana Dajko, the first on the closed list.
Rezart Kthupi, invited to "Tirana Live", stated that the decision of the KAS was not the right decision, but added that the arguments used to reach such a conclusion should be seen. He emphasized that the resignation of the candidates of the "Albania Becomes" coalition from the closed lists occurred two days after the May 11 elections and in this context, the KAS has considered their act null and void.
"Not the right decision. If the resignation had been given on April 1, the CEC, based on the law, should have required the subject to replenish the list. Technically, it is the CEC's problem, not the electoral subject's. This resignation was filed two days before the elections. Once you have gone out on the campaign trail, you cannot go out and then say they don't want you and this is the action that the KAS has deemed a null action. The electoral college will maintain the same position. Everyone else on the closed list must withdraw, so that the mandate passes to Lapaj," he said.
The Appeals Commission also rejects the appeal of Andia Ulliri, leaving the mandate to former prosecutor Arjan Ndoja. Ulliri requested the application of the Electoral Code, claiming that the mandate belongs to her due to the gender quota.
For this part, Kthupi emphasized that the sixth mandate of the Democratic Party in Durrës belonged to Andia Ulliri, taking into consideration the gender quota of the list, as provided for by the Electoral Code.
"The sixth mandate in Durrës should have belonged to the female gender. I think the conclusion reached by the KAS is wrong and the Constitutional Court's position regarding the Electoral Code is in contradiction with that position," he said.
