He refused to accept an investigative commission for the "McGonigal"
Gazment Bardhi,

The head of the Democratic Party parliamentary group, Gazment Bardhi, has reacted sharply to the decision of the Constitutional Court, which accepted the request to establish a parliamentary investigative commission for the May 11, 2025 elections, but rejected the request to investigate the "McGonigal" case.

Bardhi described the decision as evidence of political pressure on the Constitutional Court, stating that the standard used in the two cases is contradictory.

"A yes, a no, is politics, not constitutional justice," said Bardhi.

According to him, the rejection of the request for an investigative commission on the "McGonigal" affair, despite the documentation that, according to the DP, supports the investigation, raises serious doubts about the independence of the court.

Bardhi argued that the request was based on official documents from American authorities, international arbitration, and Albanian institutions, adding that only a court under political pressure could conclude that there was a lack of evidence to establish the commission.

He also noted that the decision-making on the matter was divided 4 to 4 among the members of the Constitutional Court, a situation that led to the rejection of the request.

Bardhi's reaction:

1 yes, 1 no, it's politics, not constitutional justice!

Today's decision of the Constitutional Court accepting the request to establish a Parliamentary Investigative Committee for the parliamentary elections of May 11, 2025, while rejecting the request to establish a Parliamentary Investigative Committee for the McGonigal corruption affair, is blatant evidence of political pressure on this Court.

How can it be said that the request lacked the evidence to consider it a separate case, while it is based on 7 official documents of American justice, international arbitration and Albanian justice, only a court under political pressure can say. Especially since this is decided 4 to 4, and for this reason it is dismissed without a decision, just like Edi Rama's other personal affair regarding the "Becchetti" case.

But despite this, I "understand" the Constitutional Court regarding today's decision. After all, the "McGonigal" affair is the political funeral of Edi Rama and our Constitutional Court could never have the professional courage to organize it, just like their colleagues in the Special Prosecutor's Office against Corruption and Organized Crime who have been shelved criminal proceedings no. 22, of 2023, for 3.5 years.
