
This is the first time in history since the 1990s that a sitting Prime Minister faces a criminal investigation ordered by the Court itself for a matter that involves decision-making at the highest level of the executive branch and that directly affects the lives, property, and rights of hundreds of citizens.
One of the most important and sensational developments in Albanian justice has recently been recorded, as the Special Court against Corruption and Organized Crime has officially ordered the Special Prosecution Office (SPAK) to register and launch criminal investigations against Prime Minister Edi Rama, in connection with the massive expropriations carried out in the area known as "5 Maji" in Tirana.
The investigation focuses on the procedure for the approval and implementation of Council of Ministers Decision No. 533, which was used, according to the criminal complaint filed by citizen Ledion Mziu, as the legal basis for a one-sided, unfair and manipulated expropriation process, which has never had any real public interest, but has served to favor the multi-storey construction of private companies with close ties to local and central government.

In the complaint, the main defendants are Prime Minister Edi Rama and the former Mayor of Tirana, Erion Veliaj, who are accused of having exceeded their constitutional and legal powers, abused public office and seriously violated the principles of justice and transparency in a process that was disguised as an urban development project, but which was essentially a scheme for private interests.
According to the complainant, VKM no. 533 was not used in the interest of citizens, but to legally justify the demolition of apartments, the forced eviction of owners and then the granting of land for use by construction companies that have benefited from multi-storey commercial projects. Further, the complaint argues that Edi Rama has borne the highest responsibility for this process, not only as the head of the Council of Ministers, but also as an authority that, according to Law No. 9000 dated 30.1.2003, has the legal obligation to prohibit, suspend or review any act of ministers or subordinate structures that contradicts the Constitution, the law or the public interest.
The Prime Minister's inaction in this case, despite public denunciations and long-standing protests by residents, is interpreted as tacit approval or direct cooperation in violating the law. After more than five years since the launch of the project, hundreds of families from the "5 Maji" neighborhood and surrounding areas continue to be displaced, without fair compensation and without transparency over the future of their property, while constructions have been erected on their land that have no connection to community interest or public functions, but serve as projects for the sale of luxury apartments or business centers.
The complaint requests a full criminal investigation into the entire procedure for issuing VKM No. 533, the role of state institutions, the real economic beneficiaries and their connections with public officials, as well as the individual responsibility of Edi Rama and Erion Veliaj for abuse of office, violation of equality before the law, falsification of the public interest and seizure of state institutions.
The Special Court, after reviewing the documentation, has concluded that there is sufficient evidence to order SPAK to register criminal proceedings and launch investigations, which constitutes a strong signal for Albanian justice and a key moment for the credibility of the new justice institutions. This development gives a new dimension to the “May 5” issue, turning it from a political and civic debate into a criminal investigation against the highest government figures, and reopening the wounds of an entire community that has been seeking justice for years.
Now the reaction and action of the Special Prosecution Office is awaited, which has the power to confirm or refute the charges, and to decide whether to take concrete investigative actions against the Prime Minister of the country. If this happens, it will be the first time in the history of the Albanian state when a serving Prime Minister is investigated for corruption in connection with a government decision. The “May 5” case is becoming the strongest symbol of the battle for justice and legal equality in Albania.
Initially, the criminal complaint was filed with SPAK, but then the complaint material was forwarded to the Tirana Prosecutor's Office, which registered a criminal proceeding for the criminal offense of abuse of office. After nearly three years of investigation, the prosecution requested the dismissal of the case on the grounds that there is no criminal offense, a request that was accepted by Judge Gert Hoxha through a decision to suspend the trial.
This decision was appealed by the victim's lawyers, who argued that the general jurisdiction court does not have jurisdiction to review this case, requesting its transfer to the Special Court. On 30.09.2025, the case was reviewed in the Special Court with a panel headed by Judge Rudina Palloj, where both the prosecutor Elvin Gokaj and the defense requested the case be returned for further investigation.
The judge of the Court of Appeal of General Jurisdiction in Tirana, Fatri Islamaj, has decided to transfer the case to the jurisdiction of the Special Court against Corruption and Organized Crime, thus sending the case for trial to this court. Subsequently, on 30.09.2025, the case was reviewed by the Special Court with judge Rudina Palloj, where the prosecutor Elvin Gokaj and the lawyer of the party were also present at the session, who requested the return of the case for further investigation./ Pamphlet
