Alexandros Giotopoulos, convicted as the leader of the Greek terrorist organization "November 17" (17N), which for decades carried out assassinations, murders and attacks in Greece, faces a new judicial development just days after his release on bail.
The Supreme Court of Greece has accepted the appeal against the decision that had allowed his conditional release, annulling its effects and paving the way for his return to the prison.
The case took a new direction after the intervention of the Deputy Prosecutor of the Supreme Court, Sofoklis Logothetis, who assessed that the decision of the Piraeus Appeals Council was based on an erroneous interpretation of the law.
According to the prosecution's position, for a convict serving several life sentences, Law 4855/2021 should be applied, which provides that the possibility of parole can only be considered after actually serving at least 25 years in prison.
On the other hand, the Appeals Council had interpreted that the previous legal provisions, which set a minimum requirement of 19 years of actual serving of the sentence, should have been applied. It was precisely this discrepancy regarding the applicable legal framework that constituted the essence of the appeal.
With the decision of the Supreme Court, the judicial act that had led to the release of Giotopoulos loses its legal force, while the previous rejection decision of the Council of the Court of First Instance is restored.
As a result, Giotopoulos is expected to be returned to prison until a new decision is made by the judiciary.
The case will be re-examined by a different composition of the Piraeus Appeals Council, which will decide again on the request for conditional release.
