
Former FBI Director James Comey appeared in federal court in the Eastern District of Virginia today. He was briefly taken into custody before his first court appearance. The hearing lasted less than 10 minutes.
Comey is charged with making threats against the president, according to court documents. He said in a video message on Substack on Tuesday that he is innocent.
“I don’t see why they would be necessary this time,” Fitzpatrick said.
Comey’s lawyers told the judge they plan to file motions accusing the Justice Department of selective and vindictive prosecution of their client. Tuesday’s indictment centers on a photo Comey posted on social media last May of shells on a beach forming the numbers “86 47.”
He wrote in the caption, “Awesome shell formation on my walk on the beach.”
Almost immediately after his post, Republicans and administration officials began criticizing Comey for what they called a death threat against President Donald Trump. When used as slang, the number 86 can refer to giving up or rejecting something. Trump is currently the 47th president.
The lawsuit against Comey comes at a time when Blanche has stepped up the pace of raising issues that the president has publicly struggled with. The new case represents a renewed effort to fulfill Trump's demands to investigate his enemies, including Comey, whom he sees as a key leader in a perceived effort to "weaponize" the justice system against him.
It also comes less than a month after the president fired Attorney General Pam Bondi. Trump had complained for weeks that Bondi was not aggressive enough in pursuing his agenda. "This is not going to get anywhere. This is clearly not a punishable threat ," Eugene Volokh, a senior fellow at the Hoover Institution at Stanford University who specializes in First Amendment law, told CNN on Tuesday. This is the second time the Trump Justice Department has filed charges against Comey. In September of last year, the Justice Department first filed charges against Comey, accusing him of lying to Congress about leaks to the press. The case was dismissed late last year by a federal judge, who found that the acting U.S. Attorney for the Eastern District of Virginia had been improperly appointed, having evaded Senate confirmation.
