Former Tirana prosecutor Elio Mazreku has been appointed the new director of Customs Investigation.
Mazreku was dismissed on November 23, 2023 by the Independent Qualifications Commission of the vetting committee, after facing the burden of proof regarding the legality of his family's income.
Prosecutors and judges who are removed from office as part of the vetting process face strong legal restrictions on the exercise of public functions.
With its publication in the Official Gazette and decree by the President of the Republic, Law No. 10/2026, which entered into force on February 28, 2026, imposes permanent bans on former judges and prosecutors dismissed or withdrawn from office to avoid vetting.
According to Law No. 84/2016 "On the Transitional Reevaluation of Judges and Prosecutors", this process aims to remove from the system individuals who do not meet the criteria of wealth, image and professional ability, with the aim of restoring public trust in justice.
In practice, individuals dismissed or those who resign during the process are considered unsuitable for important functions in the state and are prohibited from returning to the justice system, while for a long period (up to 15 years, according to the interpretation of constitutional provisions and reform laws) they cannot hold high public positions.
According to the KPK's financial analysis, Elio Mazreku had a negative balance of 22.8 million lek, due to the lack of evidence for the legality of a series of bank accounts that were used in the purchase of a 129-meter apartment in 2010. Also, according to the KPK, he had not justified an amount of 5 million lek from his father and several gifts from his brother.
The decision was made by a body composed of Brunilda Bekteshi as chairperson, Roland Ilia as member, and Pamela Qirko as rapporteur.
Mazreku contested the KPC's findings and insisted that the income in question was legal, came from his wife's work at an NGO, and that the payment methods were not controlled by her.
Elio Mazreku began his career in the justice system in 2000 and has been working for more than two decades as a prosecutor in the Tirana District Prosecutor's Office.

In his first declaration in 2003, prosecutor Elio Mazreku declared assets worth 17.2 million lek, while at the end of 2018, his family assets amounted to 52.7 million lek, marking an increase of almost 3 times.
He owns real estate worth 27.9 million lek, bank liquidity of 20.7 million lek, and accumulated cash savings of 4 million lek.
The family income for the reporting period is 58.7 million lek, of which almost 27% comes from the subject's salary, 37% from family members' salaries, almost 9% from cash gifts and 3.3% from rental income.
In addition to the analysis of the increase/decrease in wealth, the structure of assets and income, this report also presents the arithmetic/logical control of the entity's declarations as well as the "red flags" identified during the control. From the arithmetic/logical control for 15 years of declarations, none of the declarations resulted in problems.
But from a qualitative analysis of the asset declarations, BIRN identified as "red flags" the lack of complete data on properties and cash received from inheritance.
In the first declaration, the subject declares real estate acquired through inheritance in co-ownership and with other family members, therefore the declared value for these properties must be the market value.
The 2010 periodic/annual declaration is illegible, creating difficulties in logically linking the change in the liquidity position.
In 2008, the subject declares “Cash received after the death of my father on 18.02.2008. Source of creation: inheritance, donation from the father shortly before his death and posthumous benefit in the amount of 5,000,000 lek”.
