Former member of the Special Appeals Chamber, Ardian Hajdari, has won his appeal to the High Court, which has overturned previous decisions issued against him on the charge of failing to declare assets.
According to the enacting clause of the decision, Judge Gent Shala has decided to overturn the previous decisions against Hajdari and to dismiss the case without returning it for retrial.
"The Supreme Court has ordered the dismissal of the case without returning it for reconsideration," the decision states.
Two years ago, the Special Court Against Corruption and Organized Crime found Ardian Hajdari guilty of concealing and failing to declare assets. He was sentenced to 1 year in prison, a sentence that was converted into 2 years of probation.
After being indicted by SPAK, Hajdari was suspended from duty at the Special Appeals Chamber since February 7, 2022. If the guilty verdict were to become final, the KPA would have to decide on his dismissal from duty.
The case against Hajdari began after a criminal complaint filed with SPAK on June 24, 2020, alleging that he had made false statements during his application for membership in the KPA, claiming that he had practiced law for 17 years.
SPAK accused Hajdari of failing to declare the income he earned from his legal practice when he applied for the position at the KPA. According to the prosecution, the failure to declare was not an oversight, but a deliberate and continuous concealment over the years.
According to SPAK's investigations, Ardian Hajdari had represented dozens of cases as a lawyer, but the income derived from them was not declared to the tax authorities.
The prosecution also alleged that Hajdari had filed tax returns with zero or minimal values for years and had maintained the same position even after tax audits conducted against him.
For his part, Hajdari has repeatedly insisted on his innocence, while the KPA has not yet made a public comment following the Supreme Court's decision.
Ardian Hajdari was the second member of the Special Appellate Panel to face criminal proceedings, after former member Luan Daci, who was found guilty by final judgment of falsifying the application form that enabled his election to the KPA.
