Italy, like all EU Member States, has the right to establish Repatriation Centres (CPR) for irregular migrants subject to expulsion also on Albanian territory, without prejudice to the exclusive competences of the EU. This is what the Advocate General of the Court of Justice of the European Union, Laila Medina, emphasizes in her opinion on the Italy-Albania protocol on the management of migratory flows.

Although the Advocate General's opinion is not binding on the Court's final decision, he considers the operation of the Repatriation Residence Centers set up by the Italian government in Albania to be legal, writes Corriere della Sera .

However, Medina underlines that member states remain obliged to respect the guarantees that European legislation provides in the field of asylum. According to her, the Italian provisions included in the agreement do not seem to protect these guarantees in a sufficiently clear manner.

It seems that this stance is a support for the pact signed by Italian Prime Minister Giorgia Meloni and Albanian counterpart Edi Rama, but also a response that Brussels gives to critics of the plan, mainly the Italian opposition, which has opposed the scheme chosen by the Meloni Government.

Meanwhile, the new European Pact on Migration and Asylum enters into force today, a development that is expected to significantly change the legal framework on which the complaints of immigrants held in centers established in Albania have been based so far.

The European Union took another step towards the model of return centers outside the territory of the union.

Member state ambassadors supported new rules that pave the way for EU states to enter into agreements with third countries to establish centers where migrants who have been ordered to leave European territory can be transferred.

Italy is considered the country that has gone furthest in this direction through the agreement with Albania, and is seen as a model that can be adopted by other European countries.

The Repatriation Residence Center (CPR) operates in Gjadra, with a capacity of 96 places.

According to Italian authorities, 527 migrants have been treated since its launch, while dozens have been repatriated. Giorgia Meloni's government considers the project a new model for migration management and has repeatedly expressed its desire for similar schemes to be implemented in other countries.

On the other hand, Prime Minister Edi Rama has stated that the model of migrant centers in Albania remains an exclusive agreement with Italy and will not be expanded to other countries. However, everything remains to be seen, because recently Berlin is also looking for a place to set up its camps for asylum seekers who lose their right to stay and must be repatriated.
