The Special Prosecution Office today imposed the security measure "house arrest" on lawyer Besart Logu, following the request of SPAK. The Special Prosecution Office announced in an official announcement that there are reasonable suspicions, based on evidence, that the person under investigation has committed the criminal offense of "Exercising illegal influence over persons exercising public functions", as provided for in Article 245/1/4 of the Criminal Code.
"On 27.11.2024, the Special Prosecution Office Against Corruption and Organized Crime registered criminal proceedings no. 242, on the complaint of the citizen with the initials SC, for the criminal offenses:
“Passive corruption of judges, prosecutors and other officials of the justice system”, (Article 319/ç of the Criminal Code);
"Exercising unlawful influence over persons exercising public functions", (Article 245/1 of the Criminal Code).
From the proactive investigations, which were carried out by investigators of the National Bureau of Investigation (BKH) and the General Directorate of the State Police, it resulted that on 13.12.2024, the suspect received the amount of 8000 (eight thousand) euros, (a fact documented through special investigation methods). This amount was taken with the aim of influencing the prosecutor, judge and experts who were in charge of the criminal case against him at the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Tirana. The case concerned the criminal offenses, "creation of fraudulent schemes related to value added tax", committed in collaboration, "Hiding income" and "Forgery of seals, stamps or forms", committed in collaboration, provided for by articles 144/ae 25, 180/3 and 190/2 of the Criminal Code.
Investigations have proven that this amount was not a payment for legal services, but an amount given against the promise that it would be handed over to the prosecutor, judge and experts for the release of his client, SC, from prison. This promise has not been fulfilled ," SPAK's official announcement states.
Meanwhile, lawyer Logu, in his reaction, states that during the search by police agents, no illegal items or any other evidence related to the subject of the investigation were found.
" No action has been taken on my part that could raise suspicions of any possible criminal offense. Throughout my career as a lawyer, I have served with great devotion and responsibility, prioritizing only the client's interest, and this within the framework regulated by law."
In relation to the specific case, I have not been involved in any episode of corruption or illegal act. I have only done the work of a lawyer, both in setting up the defense and in meetings with family members and acquaintances of the client, whether these are undercover agents. I am able to prove my every act and prove all the claims raised by the Prosecution. This is because there is nothing new except the daily routine of a lawyer.
The bad news in this whole story is that there is an attempt to criminalize the behavior of lawyers. This tendency is also seen in the amendments to the Criminal Code, where the government considers as a criminal element even the case where you have received more money than you have provided services.
So, I am willing to face this accusation because I am convinced of an absolute truth:
▪︎ I have not received any money for exercising illegal influence.
▪︎ I have not met any justice official
▪︎ And no illegal service has been taken back.
"This is proven by the case in question and its entire course ," he writes.
