The Republican Guard will take personal protection even after the end of duty, if their lives are in danger.

Currently, the law stipulates that a number of personalities, such as the President, Prime Minister, Minister of Interior, etc., are protected by the Guard even after they leave office.

But according to a VKM approved today, anyone currently protected by the Garda and feels threatened after completing their duty will continue to receive this service. It is not known whether this decision is related to any event or danger that has threatened any former official.

I. CONDITIONS FOR OBTAINING SPECIAL PROTECTION

1. The Guard of the Republic of Albania guards and protects, after the end of their duty, dignitaries or their residences, when their life, health or family is at risk due to the duty they have performed.

2. The conditions for benefiting from physical security and protection of the apartment are:

a) the presence of serious circumstances that endanger the life, health or family of the individual or his/her residence, within six months of the end of the assignment;

b) the presence of a causal link between the serious circumstances and the exercise of the previous function by the personality.

II. PROCEDURE FOR GRANTING SPECIAL PROTECTION

1. The request for protection, according to point 1, chapter I, of this decision, is submitted in writing to the Minister of Interior by the endangered individual himself.

2. The request for protection shall contain:

a) the full credentials of the applicant;

b) a summary of the facts and circumstances that constitute a serious threat to his personality or residence, which oblige him to seek protection even after the end of his duty.

3. The Minister of Interior shall immediately, but no later than 24 (twenty-four) hours, order a meeting of the Special Commission to assess the request.

4. The Special Commission evaluates the submitted request, as the decision-making authority for special protection.

5. After reviewing the request for the need for protection of the person or his/her residence, the commission shall make a decision within 48 (forty-eight) hours. The decision shall be notified to the Minister of Interior and the endangered person.

6. The Commission, in the process of reviewing the request for protection, according to this decision, may request information from other institutions.

7. The decision contains the level of security and protection measures, the number of bodyguards or guards for the residence, the duration of protection, as well as other measures related to this protection.

8. Protection of the person or residence lasts as long as the circumstances of danger are present, but not more than one year.

9. Upon the expiration of the maximum period of protection, according to point 8 of this chapter, the Special Commission decides to:

a) continuation of protection with the same measures;

b) completion of the defense;

c) changing security measures.

10. Following the commission's decision, the Guard of the Republic immediately takes the endangered individual or residence under protection, implementing the measures specified in the decision.

III. COMPOSITION AND FUNCTIONING OF THE SPECIAL COMMISSION

1. The Special Commission consists of:

a) Deputy Minister of Interior;

b) the Deputy Director General of the State Police;

c) the Deputy Director General of the Guard of the Republic;

ç) a representative of the Special Prosecution Office against Corruption and Organized Crime;

d) a representative of the National Bureau of Investigation;

dh) a representative from the State Intelligence Service, at the level of director of the department;

e) a representative from the Defense Intelligence and Security Agency, at the director level.

2. The Chairman of the Special Commission, defined in point 1 of this chapter, is the Deputy Minister of Interior.

3. Participation in committee meetings is mandatory. Committee meetings are valid when no less than 5 (five) members with voting rights are present.

4. The decisions of the committee are valid when approved by more than half of the members present at the meeting.

5. The chairman of the committee appoints a technical secretariat, which supports the organization, functioning and keeps the minutes of the meeting.

IV. FINAL PROVISIONS

The Ministry of Interior and the Republic Guard are charged with implementing this decision.

This decision enters into force upon publication in the "Official Gazette".
