
The Lezha Prosecutor's Office is requesting for the second time the suspension of investigations regarding the concession for the construction of 4 small hydroelectric power plants in Kaçinar, Mirdita, which has been opposed for 7 years by the residents of the area.
According to the prosecution, the investigation was requested to be discontinued because, contrary to the residents' complaint, no elements of the criminal offense of "abuse of office" and "falsification of documents" were found.
The request to discontinue the investigation has been submitted to the court and is being reviewed by Judge Iva Caca, but the prosecutor's decision has been met with anger by residents of the area.
"We have been in this battle for 7 years and unfortunately, the prosecution has sided with the lawbreakers, regarding this concession," said Gjon Pjetri, a resident of Kaçinari.
"We have filed a lawsuit against the concessionaire company and the Mirdita Municipality for forging documents and signatures of residents. But despite the duties left by the court in two cases, the prosecution has again come with a request for a recess, without carrying out any investigative action. We have had two sessions that have failed, because the prosecutor is absent - and this is absurd," added Pjetri.
The village headman, Simon Gjergj Deda, is also in the same line, and he opposes the Prosecutor's Office's decision.
"This is a concession with many problems, which should have been properly investigated. But nothing has been done about the complaint we made 5 years ago. The court had returned it twice for further investigations and none of the tasks set were taken into account," he said, accusing the Prosecution of being party to the illegality.
The concession for the construction of 4 small HPPs in the Kaçinari area of Mirdita was granted in 2018. After the renewal of the permits, the company "Shperdhaza Energji" has begun work on the ground to implement these projects, despite the opposition of residents.
The residents of Kaçinari sued the concessionaire and the Mirdita Municipality officials who had granted the permits to the Special Prosecutor's Office, but the latter registered criminal proceedings for the acts of "abuse of office" and "falsification of documents" and transferred the case to the Lezha Prosecutor's Office./ BIRN
