In the Durrës District, the 'DP-ASHM' coalition managed to secure 6 parliamentary mandates, out of a total of 14 in this district. Five of the names that received the mandate belong to the closed or predetermined list, while the 6th mandate comes from the open list.

Referring to preferential votes, the mandate went to former prosecutor Arjan Ndoja, who collected 9,167 votes.

Following him are Aulon Kalaja and Andia Ulliri. Kalaja has raised allegations regarding the process and the vote counting, warning that he will pursue the issue to the end, even though he is ranked about 1,000 votes less than Ndoja.

And while Kalaja has begun his battle, also taking video footage from the vote counting process by polling center, Andi Ulliri claims the mandate from the open list, basing her request on respecting the gender quota in the distribution of mandates.

Ulliri emphasizes that the ranking of winning candidates, as currently reflected on the official CEC website, does not respect the gender representation clearly defined in the Constitution and the Electoral Code.

"Your action to declare Mr. Arjan Ndoja, who is ranked first on the list with preferential votes, elected is contrary to the law and constitutes a violation of the constitutional principle of gender representation," states the request that Ulliri has sent to the CEC.

On the other hand, she refers to the recent legal changes approved by the Assembly, where she claims, through an amendment to the Electoral Code, that one in every three winning candidates on the list, after reordering by preferential voting, should belong to the less represented gender.

"In cases where the reordering does not result in one in three names belonging to the less represented gender, starting from the top of the list, then the third candidate on this list and subsequently one in three names belonging to the less represented gender according to the number of votes they received," the complaint states.

Ulliri emphasizes that this interpretation was also supported by the Constitutional Court in its decision No. 85, dated 24.12.2024, where it was affirmed that the electoral list is one and only, divided into two parts for technical purposes, but that in the final distribution of mandates, a gender quota should be applied to the total list.

"The interpretation made by the CEC is unsupported by the law and by any decision of the Regulatory Commission. We are dealing with a unique list, which should guarantee that 1 in 3 winners are from the less represented gender," emphasizes Ulliri.

If we refer to the distribution of mandates by the CEC, it is noted that in the Durrës District, in the case of the Socialist Party, the mandate of the deputy is received by Etleva Budini, even though she was ranked below Ilir Ndrazhi and Gentian Hilla, two candidates from the open list, the former of whom received 3 thousand votes more than Budini, while the latter received about 900 votes more than the name given the mandate due to the gender quota.

The interpretation that the CEC will make of this request is now awaited, and then the process can continue with other levels, where Ulliri can file complaints.
