The Special Court Against Corruption and Organized Crime (GJKKO) is holding a hearing this Wednesday against Leonard Duka, accused of the murder of Santiago Malko. During the trial, the evidence collected and the testimonies given were discussed.

Leonard Duka's lawyer raised doubts about the way Blendi Tetë's testimony was handled, stating: " During Blendi Tetë's questioning, the prosecutor took her to another session, telling her not to make a statement. This is in violation of the law. Who were the police officers who accompanied Blendi Tetë to the GJKKO halls? The prosecutor asked her not to make statements in front of the black squads. We demand that the officers be called and that they declare who asked Blendi Tetë to accompany them to another hall. We demand that the court verify Blendi Tetë's statements."

She also sought clarification on the SKY ECC codes.

"We want to know if the Sky ECC code that was allegedly used by Leonard Duka was used by only one person or several? We want to ask Erlis Duka, Leonard Duka, Ervis Martinaj, etc., if they are Sky ECC users or if they stand by the evidence brought by the prosecution. We also want to call Muhamed Duka, Leonard Duka's father, to give statements regarding the alleged incident ," said the lawyer.

For his part, prosecutor Behar Dibra described these requests as unfounded.

" I find the requests unfounded and unsupported in terms of this trial. Regarding the lawyer's claim about my contact with Blendi Teta, it is true that I have contacted him. There is no legal obstacle here. The method of identification of the Sky ECC application is that of the judicial police, there is no other way. Regarding the summoning of persons to give testimony, the fate of Ervis Martinaj, his location, and more, is not yet known. Some of those requested by the lawyer are part of this trial. Leonard Duka can definitely testify. The others are unfounded ," said prosecutor Dibra. 

The Special Court decided to reject the request to summon police officers in this process, arguing: “It was explained in the courtroom by the defendant and the prosecutor that they met.

The court considered it unnecessary to verify Blendi Teta's statements and announced that the acts on Sky ECC's letter of request were obtained within the framework of another proceeding.

Regarding the summoning of the persons wanted as witnesses, the court explained: " As soon as there is a notification from the police about their capture, then they can appear to testify. For Ervis Martinaj and others, there is no information about their whereabouts ."

The court accepted the defense's request for Muhamed Duka to appear as a witness in the trial. The next hearing is scheduled for June 24, at 09:00.
