In conclusion, 'Helsinki' assesses that the automatic placement of defendants in cages in the courtroom jeopardizes the fairness of the process. What does the European Court of Human Rights have to do with this? We are in 1945 when 'Napoleon the Pig' was making the law on the Farm.
Here are three main characters, not as many as there were in Orwell's novella “Animal Farm.” Three, but with a caveat: The 'animal' character type can come in handy as it increases in number.
The characters are almost direct similarities, from 'The Farm...' of 1945, to The Farm of Tirana, April 2026.
So, we are listing the character in the 'Animals' category, which ranks first.
The second most important character is the Court Against Corruption and Organized Crime (CAC). This constitutes a new, exciting, and glorifying factor for our society. The parallel with 1945 can be drawn with the new Stalinist power that came to Moscow.
The third character is the Albanian Helsinki Committee, which is striving for human rights outside the Farm where the animals are protesting.
The 'farm' in the GJKKO trial is represented by a cage where animals were locked up. The animals here are people, even people who in their era were important as heads of state.
Along the way, other secondary characters may enter and exit the scene, such as the lawyer, etc.
This is the whole scene, not of comedy like Orwell's, but the drama of our Justice.
The Albanian Helsinki Committee, the day before yesterday, distributed an alarming statement to the media about the 'Animal Farm' in court. It was triggered by the protest of the defense lawyer of Mr. Ilir Beqja, former minister, accused by SPAK and GJKKO for legal matters. Their business. The lawyer complains that his client, Beqja, is caught as soon as he enters the courtroom, a cage is brought and he is thrown inside. At first it was a metal cage, while now it has been replaced with a glass cage.
The lawyer complains as much about his own plight as about the suffering of his client. His plight is how to communicate with the client. He has to get into the cage, then out; then in, then out. In this way, the lawyer also becomes a 'criminal', that is, a defendant, condemned to the cage.
He complained but who listened?!
The lawyer's appeal was dismissed on April 7, 2026. The court justified the decision by stating that 'the cage is not mine, I did not put it there'.
It sounds like a 'Pigs on the Farm' argument, but it's true. The KKO Court of First Instance announces its decision that 'the Prison Directorate provides the cage'.
Severe, almost a psychological trauma. In the courtroom, even a special court, where the eyes of millions of people's hopes are fixed, the law does not rule, neither the judge, nor the prosecutor.... The Prison Directorate decides. A saboteur lands in the courtroom every day. The prison also decides Justice. This Directorate brings and takes away the cage. It puts the animal in the cage, then takes the cage away from the animal. As if it were in a psychiatric hospital where they bring and take away the prisoners.
The Helsinki Committee does not disclose the name of the lawyer; perhaps there is a reason. Because it does not matter. After Mr. Beqja's lawyer, Mr. Meta's lawyer will come, then Mr. Berisha's, then Mr. Malltezi's... Take away the 'Uturaks' and bring them.
The Albanian Helsinki Committee is trying to raise its voice and say that this practice of the Court 'constitutes a serious violation of domestic legislation and the standards of the European Court of Human Rights'.
Good, good! Who knew that on the Farm during Stalin's time, the laws for animals were being violated?
But 'Helsinki' doesn't tire and continues:
“First, according to Article 341 of the Code of Criminal Procedure, the conduct of the court session and the maintenance of order in the courtroom are the exclusive competence of the court.
Secondly, Article 344 clearly provides that the defendant participates in the trial as a free person, even when he is detained. Restrictions are allowed only if he impedes the conduct of the hearing. In this context, the Court's argument that placing a person in a cage is the competence of the General Directorate of Prisons, conflicts with the criminal procedural law. Neither Law No. 81/2020 nor the relevant sub-legal acts provide for the use of a cage as a standard measure in the courtroom.
Third, this practice also contradicts the jurisprudence of the European Court of Human Rights. The European Court of Human Rights has underlined that there is no justification for treating a person like a “wild animal”.
In conclusion, 'Helsinki' assesses that the automatic placement of defendants in cages in the courtroom jeopardizes the fairness of the process.
What does the European Court of Human Rights have to do with this?
We are in 1945 when 'Napoleon the Pig' ruled the farm.
Po mundohem dhe po vras mendjen te gjej nje fjale sadopak te vogel te mire per kete shkruajtesin e kesaj "letre" si ne vakt, por nuk e gjej dot. I tille ka qene dhe do mbetet
