Ervis Martinaj has been missing since August 9, 2022, and since then, authorities have never officially confirmed what happened to him.
Mustafa Martinaj appeared today at the Special Court to testify in the process regarding the properties of his son, Ervis Martinaj.
The hearing failed due to the absence of two prosecutors in the case.
At the end of the session, Mustafa Martinaj, asked what happened to his son, said that "everyone knows the fate of my son, except the media and the Prosecution."
"My son was executed in Durrës, how do I know?! I'm the father! And I gave explanations about this issue before the explanations of the National Bureau of Investigation, where I appeared on my own initiative, I came myself 2 months after the event. They don't want to investigate it and have left it to Kurbin," said Mustafa Martinaj.
Asked by the media if he was interested in what the city's Prosecutor's Office is doing with the investigations, he said "I have nothing to be interested in. I don't even have the power to take revenge. I came because the court summoned me, I am disabled, I have had some health interventions. These people deal with trifles and don't deal with major things."
The next session was postponed for two weeks, as the trial on SPAK's request for the confiscation of certain assets continues.
Two other citizens were also present as witnesses requested by SPAK.
Ervis Martinaj has been missing since August 9, 2022, and since then, authorities have never officially confirmed what happened to him.
Ervis Martinaj's assets, GJKKO leaves the seizure in force
The Special Court has rejected the request of the family and legal defenders of the missing Ervis Martinaj, who requested the lifting of the seizure and the release of their assets. The lawyers claimed that the request was submitted to the court about two years ago, exceeding the legal deadline of one year for review.
It is learned that after reviewing the case, Judge Erion Bani decided to leave the seizure measure in force, describing the defense request as unfounded in law and evidence.
Among other things, Judge Bani explained that the Prosecution has the authority to investigate for up to two years from the imposition of the seizure and that the term of this measure has been legally extended twice, remaining in force until December 2025.
According to the Court, the security measure is lifted only if the prosecution fails to request confiscation after the expiration of the extended deadlines. Given that the request for confiscation was filed within the legal deadlines, the Court assessed that we are not in a position to extinguish the measure for the 34 assets seized since 2023.
The process is expected to continue with the next session, where, at the request of SPAK, a group of people who own properties linked to Ervis Martinaj will be questioned as witnesses.
