For almost two years, the State Cadastre Agency refused to open its doors to the highest constitutional audit institution. Today it is clear why. The report of the Supreme State Audit reveals an institution where recommendations are not implemented, disciplinary measures remain on paper and the law is systematically ignored...

When the head of the Supreme State Audit Office, Arben Shehu, appeared before the deputies and declared that for almost two years the Supreme State Audit Office had not been allowed to audit the State Cadastre Agency, the alarm was clear. The SAO had become an institution closed to constitutional control, while its leaders refused to open their doors to auditors.

Today, the official report of the Albanian Supreme Audit Office (ALSO) reveals what was behind this deadlock. The document highlights an alarming picture of non-implementation of recommendations, lack of accountability and disregard for legal obligations in almost all of the most important Cadastre directorates.

The figures are shocking. The SAI has left 359 recommendations, of which 98 percent have been accepted, but only on paper. In practice, only 18.5 percent of organizational measures have been implemented, only 4.7 percent of measures for the administration of funds have been implemented, while the balance for administrative responsibility is almost scandalous: only 0.7 percent of disciplinary measures have been implemented, which means that 99.3 percent of them have remained unimplemented.
Instead of the recommendations of the constitutional audit institution being transformed into concrete measures, they have remained worthless papers.

The report shows that the problem is not isolated, but extends to the entire structure of the Cadastre.
In Tirana North, 18 out of 19 organizational recommendations have not been implemented. Four financial recommendations have never been implemented, while 24 disciplinary measures have all remained on the shelf.
In Tirana Rural II, the panorama is even more serious. Out of 32 organizational recommendations, 22 have not been implemented, while 10 out of 11 recommendations for the administration of funds have remained unimplemented. Another 31 disciplinary measures have not been executed.

In Tirana South, only one organizational recommendation was fully implemented. 12 were not implemented, five were partially implemented, while 18 disciplinary measures remained unimplemented.

In Tirana Rural I, 23 disciplinary measures have not been implemented, while in Kamëz-Vora, 22 out of 32 disciplinary measures have remained unimplemented, along with a significant portion of organizational recommendations.

In almost every audited directorate, the SAI finds the same pattern: action plans for the implementation of recommendations have not been drafted, mandatory reports have not been sent, and obligations stemming from the Law on the Supreme State Audit have been ignored.

This report takes on another dimension if read together with the public statements of the head of the SAI. Arben Shehu has denounced that the SAI has blocked every full audit for nearly two years, asking the Parliament to intervene to restore the normal functioning of constitutional control.
In the same report, the SAI highlights that 27,023 court decisions and the Property Management Agency continue to remain unregistered, that 11 percent of complaints in Albania are related to property issues, while auditors have also found cases of property alienation with forged documents and signatures in the coastal area.

Meanwhile, another front is weighing on the State Cadastral Agency. SPAK has undertaken investigative actions on issues related to property administration, including seizures in the Himara area, while investigations have also focused on suspicions of illegal property registration and legalization schemes.

So the fact that Lorena Goxhobelli closes the door to the KLSH clearly proves that the bargain is very big and SPAK has the evidence there. Property affairs in Albania are the biggest affair and SPAK or district prosecutors cannot deal with former directors or some peripheral officials. The first to line their pockets are the big directors and SPAK should start with Lorena Goxhobelli. /Pamphlet
