Prime Minister Edi Rama announced yesterday the decision to dismiss Erion Veliaj from the post of mayor of Tirana. At the meeting of the Socialist Party National Assembly, Rama asked the socialist members of the capital's Municipal Council to activate the mechanism for the dismissal of Mayor Veliaj, who has been in detention since February 10 of this year.

Regarding this issue, lawyer Arbër Hoxha was invited to 'Studio Live'. When asked about the cases when the prime minister can dismiss a mayor, Hoxha highlighted three main reasons.

"Mr. Rama may be within his political right but not his legal right to take measures to dismiss even the mayor. The three cases when the prime minister can dismiss a mayor are: first for serious violations of the constitution; when he is sentenced by a final decision and third when he does not appear for duty for three consecutive months.

There is only a notice of indictment against Mr. Veliaj, and there is no decision by the judge of the preliminary hearing. According to the constitution, only after the case goes to trial and there is a decision by the court, this person will be named as a defendant. Veliaj has a security measure that obliges him not to appear in court.

"For these reasons, Veliaj cannot be legally dismissed, then politically it belongs to the prime minister or the municipality. In these cases, Veliaj, according to the law, has the opportunity to attack this decision in the administrative court or the administrative appeal court ," said Hoxha, among other things.
