
Former prosecutor Eugen Beci spoke about SPAK's current challenges, emphasizing that the institution has entered a crucial phase, where results will be measured in court and no longer in the investigation.
He gave an example to illustrate the difference between investigation and trial. “A prosecutor said: 'I'm good at investigation, but I'm a bit lame at trial'… and the officer told him: 'The job is trial,'” Beci said.
According to him, SPAK has already passed the initial phase and is facing a more difficult test. "SPAK has passed that phase of maturation and the exercise of criminal prosecution... now we are at the moment of standards," declared Beci.
Beci stressed that the main challenge remains the balance between law and politics. "We will see if SPAK can manage the risk between what is called legal and what is called political," he said, adding that this will be tested at all levels of the trial.
He identified three main directions of SPAK's investigations. For old files, such as 21 January or Gërdeci, he highlighted the problems with evidence. "There are major shortcomings... due to the obsolescence and destruction of evidence over the years," Beci said.
Regarding the investigations against high-ranking figures, he pointed out the political conflict that has accompanied these processes. "The majority called it a success story, the opposition a selective blow," he declared.
As for issues related to the current government, he raised questions about SPAK's approach. "Here we will see if we have hesitation or prudence," said Beci.
The former prosecutor also criticized the public perception of the criminal process. "The public... remembers that he was convicted. No, that's where the process began and it will be a saga that will continue ," he stressed.
According to him, politics has also faced the consequences of the justice reform. "It now seems as if both the majority and the opposition are speaking with one voice," said Beci.
He added that the majority itself has changed its approach towards SPAK. "Until yesterday, the majority said that I gave it the sword... now it says wait a minute because it seems to me that this one who grew up is hitting me," declared Beci.
Beci stressed that the future of SPAK depends on its ability to manage these complex files. "We will see how competent the prosecution will be in controlling these files," he concluded for "A2 CNN."
