Some members of the Supreme Court of Justice expressed uncertainty regarding the legal criteria for selecting court presidents, finding assistance from international experts as a solution.

The High Judicial Council, KLGJ, decided on Wednesday to postpone for the third time the review of draft decisions on the verification of candidacy criteria for court presidents, after members of the Council expressed different positions on how they understood the legislation.

The discussions were mostly held around the definitions provided for in letters (b), (i) and (ii) of point 6 of article 47 "Minimum professional experience criteria for promotion", in the law "On the status of judges and prosecutors in the Republic of Albania".

According to these legal provisions, for the promotion to the office of magistrates in first or second instance, among other things, a candidate must meet the required indicators for organizational and managerial skills, such as experience as a deputy president, president of a section or magistrate for press issues; experience in management positions in public administration or justice, or experience as a member of the Council, which has been completed at least three years ago.

Some of the members expressed that they were unclear whether organizational and leadership skills were required as a criterion together, or whether only one of them was sufficient. One of the members tried to clarify the legal definitions by arguing also on the basis of the grammar of the Albanian language. Also, another member emphasized that the law was written 'in black and white'.

However, in the end, the proposal of one of the members was accepted, who requested that, before determining the criteria for promotion in this process, the opinion of the "JUSTAL" project be obtained, which according to him has contributed to the drafting of the legislation.

In addition to Wednesday's meeting, the consideration of these draft decisions has also been postponed to the plenary meetings of June 24 and 16.

The candidates in the race are: Judge Ermira Dedja for the position of president of the First Instance Court of General Jurisdiction in Shkodra; Judges Dhimitër Lara and Engert Pëllumbi are running for the position of president of the Special Court of Appeal; Erjon Çela has run for the position of president of the Special Court of First Instance and Judge Ramiz Lala for the position of president of the Administrative Court.
