Democratic Party MP Ivi Kaso raised the issue of electoral crime in the Commission, accusing SPAK of applying double standards. According to him, the Special Prosecution Office has been harsh in its measures against opposition leaders, while failing to crack down on criminal groups that have influenced the electoral processes.

In response, the head of SPAK, Klodian Braho, emphasized that electoral crime remains a worrying phenomenon for the institution, but underlined that any criminal proceedings are based solely on evidence and not on perceptions or political claims.

Braho said that SPAK considers electoral crime a serious problem, recalling that it is not a recently created phenomenon, but a problem that has accompanied electoral processes for years.

"Electoral crime is a phenomenon that is worrying and it worries us as a prosecutor. It is not a phenomenon that we agree with. It is a phenomenon that was not created within a year or two years, it has a long period of time," he said.

The head of SPAK emphasized that investigations and the filing of charges cannot be based on suspicions or perceptions, but only on evidence administered during the investigation.

"What we need to understand... is that cases are based on accusations when evidence is found. Without evidence, neither accusations can be filed nor cases can be sent. I don't see any double standards... for representatives of one side or representatives of the other side," Braho declared.

He added that allegations of unequal treatment are a matter of perception and that SPAK is not influenced by political statements, but by the materials contained in investigative files.

Braho also guaranteed that in the Special Prosecution Office, it cannot happen that evidence is neglected during investigations, emphasizing that any evidence administered is treated according to the law.

In conclusion, the head of SPAK reiterated that the institution does not comment on political statements and that all citizens are treated equally before the law, regardless of their political affiliation.

"I am taking the issues one by one in the order that you raised them. Regarding electoral crime, we had a long discussion in the relevant committee and there we gave and presented all the figures that we have and you mentioned them today in a summarized manner. Electoral crime is a phenomenon that is worrying and it worries us as the prosecutor. It is not a phenomenon that we agree with. It is a phenomenon that was not created within a year or two years, there is a long period of time.

What we need to understand, I invite you to think about yourself and you in the role of a lawyer or prosecutor, that cases are based on accusations when evidence is found. Without evidence, neither accusations can be raised nor cases can be sent. I do not see any double standard, to tell you the truth, for the representatives of one side or the representatives of the other side. You have also mentioned several cases and I do not see a connection between these cases and the reaction of SPAK on electoral issues.

But I think this is a perception. It is among politicians, it could be even broader, but from our side we do not start from perceptions, we start from what the file has. And I assure you that if the file contains the necessary evidence, whoever it is, from whatever side it is, will be held responsible for the action they have committed.

Regarding the second topic related to a request that we have submitted to the parliament, the relevant committee... the prosecution has been clear about the requests, it has been clear about what it has requested. But today I cannot evaluate or re-evaluate the position of the assembly on a certain request. I cannot give further concrete details, it is a concrete issue. Perhaps at a later moment the prosecution will come to a position or have a statement, but I cannot comment on a concrete issue today. What is clear is that the prosecution has reflected in that closed-door discussion what it has requested and the reaction of the prosecution after the assembly's decision is also clear. Regarding the third topic, for our part, we do not label the files with names or...

In SPAK, everything is criminal by number, date, and year. I don't want to dwell on specific cases again, nor... even if I wanted to, it is a case that is under investigation, but what I guarantee you is that it cannot happen in the special prosecutor's office that there is evidence in a file, for any type of file, and that evidence is left there dormant or not reacted to. Let's make one thing clear, a specific file is another thing, another thing can be said, it can be talked about, but these are not elements of evidence, these are conjectures, opinions.

Of course, at a certain point, the investigations will be completed and that is the moment when the institution can be more transparent about a certain investigation. You mentioned political statements or comments, we do not comment on the political comments of any party or person. We have shown with previous cases and the cases we have in development that for SPAK, everyone is equal before the law. Thank you," said Braho.
