In the Committee on Legal Initiatives, DP MP Gjin Gjoni asked SPAK head Klodian Braho a question regarding the possibility of launching investigations against Prime Minister Edi Rama or subpoenaing him as a person in the know about the "Albanian Files" case and other issues.
Meanwhile, the head of SPAK, Klodian Braho, responded by saying that he would not comment on specific issues, while emphasizing that any person can be investigated if there is evidence and investigative needs.
" I have no comment. If someone has evidence, they are invited to submit it and receive a legal response according to the law. No person is immune from SPAK. I say this with conviction. The condition is the investigative need and evidence of the commission of a criminal offense ," said Braho.
Responding to questions about the administration of seized and confiscated assets, the head of SPAK explained that the institution's competencies end with the criminal process and the issuance of the order for execution of the confiscation decision.
He explained that the administration and final disposal of confiscated assets is an administrative procedure carried out by an inter-institutional committee, where SPAK is represented by only one member and has no decision-making role.
Braho stated that he is not aware of any cases where persons whose assets have been confiscated have indirectly recovered them. However, he guaranteed that if such cases are identified, SPAK will launch investigations against any public official or person involved in violating the law.
"Regarding the issue of money laundering, yes, it is an issue that is of concern to us. The indicators we have in the cases registered year after year are sufficient indicators to make a risk measurement and it is a criminal activity that is assessed by us as high risk.
And it is such behavior, it is included in the priority issues of SPAK, but we must understand that the crackdown on this activity is related to SPAK only when the proceeding is related to another proceeding in subject matter jurisdiction, that you understand this. And the latest investigations precisely show a change in SPAK's approach to these criminal phenomena.
I also share the same opinion that the products of criminal offenses cannot be present in the economy, they harm the honest economy, increase the potential for committing other criminal activities, increase the financial power of organized crime and it is precisely this product that is the source of corruption and the phenomenon of corruption. Therefore, it is an activity that is among our priorities.
