9 years after the justice reform, Spahiu: Judges and prosecutors still fear Rama

Lawyer Kreshnit Spahiu says that the justice reform has been successful for SPAK and a very important part of this institution, which has also yielded tangible results. 

But according to him, the new judiciary seems to have a major problem: It is afraid of affecting Sali Berisha and Edi Rama or of bringing serious charges against them for serious issues that Albania has had over the years.

He analyzed the situation of justice on the 9th anniversary of its reform, politics, the post-election period, Prime Minister Rama's orders for Municipalities, and the action to liberate public spaces.

"SPAK is an important part of the justice reform in 9 years. But I think that the Court and the Prosecution are still afraid of Rama and Berisha. They are untouchable, because a prosecutor and judge have not yet come forward to take them to the prison cell, to file real charges, and there is still not one of them to file a real charge against them, even though there has been a case. We all see how Berisha always accuses the justice system and they are silent. SPAK, GJKKO, KLP, KLGJ are silent, embassies are silent, the Ministry of Justice, which does not happen with any other person. It is enough to see how Rama addresses the prosecutors, tells them 'dare to take my phone'! But this does not happen for other officials who have been prosecuted, there have even been arrests for a cell phone or a box of fish", Spahiu said for "Report TV". 

He added that there are files with which justice can be taken for the high-ranking officials in question, but no action is taken because one does not dare. According to Spahiu, even the decisions of the Strasbourg Court for January 21 have been violated and again justice does not dare to act. Because according to him, "the political pressure on them is very high."

"There are endless issues to be addressed, it's not that there aren't any, but no action is being taken. Let's not forget that the decisions of the Strasbourg Court have also been violated, such as the order for the trial of January 21 and there is silence, no one acts, because they don't dare. I'm not implying, I'm one of those who believe that the Court and the Prosecution are independent, but the political pressure is very high, everyone has children, families and I understand them, because the pressure exists, but this is the reality", he said.
Spahiu took the example of Kosovo's standards with justice, comparing them.

"Take Kosovo for example, where for a slur or threat on Facebook on social networks there are arrests or bans, even for blackmail and insults. Whereas in Albania I still don't see such a thing. There are high public expectations for this reform. I even think that judges and prosecutors are themselves victims of the reform, because they have been arrested or removed from office even for a studio apartment, and even the president of the Constitutional Court was convicted for a 40 square meter beach house that was not proven to belong to anyone. So the judges condemn themselves, but they don't dare for politics, they are afraid. Because for someone who builds 22 towers they don't dare, but they act for themselves," the lawyer argued, among other things, for Report TV.

He even goes further, stating that even those proceedings or arrests that are made for high-ranking officials seem like bargaining chips in politics. Here he referred to the Berisha-Meta case, making a reference to the case of the long-term detention of Mayor Erion Veliaj.

"We recall that Berisha was released at the time that Meta was arrested, we do not have the principle of equality of law, but the principle of the market of living things or the bazaar, where one enters and the other leaves. It is even one of those cases when the Special Court did not adhere to its standard with the measures for house arrest or prison, it did not follow the same standards ," said Spahiu.
