
The draft for the New Criminal Code has caused many critical reactions from professionals and the ranks of the judiciary, as well as various public figures from politics.
Maks Haxhia and Olsian Çela were among the first to speak out against it, stating that there are more punishments than under communism, and even adding that many of the punishments are ridiculous.
One case is the one below, where the new Penal Code provides for prison for violence during the match, up to fans for "possession or use of pyrotechnics, fireworks, flares."
Article 410
Hitting an athlete, coach, referee, sports mediator
1. Hitting or other acts of violence against an athlete, coach, referee, sports mediator or any person related to a sports activity, committed because of it, by persons outside this activity, is punishable by imprisonment from one to three years.
2. The same offense, when committed in sports facilities, or committed by leaders or members of sports clubs, is punishable by imprisonment from one to five years.
3. In any case, the court shall impose the additional penalty of prohibiting the perpetrator from participating in sports activities for a period of up to five years.
Article 411
Violent acts at sporting events
1. Entering the playing field, during the development of a sports activity, by unauthorized persons constitutes a criminal offense and is punishable by a fine of fifty thousand to one hundred thousand lek.
2. When this act has resulted in the obstruction of the normal development of sports activity, it is punishable by a fine or imprisonment of up to three months.
3. Throwing hard objects on the playing field or on a crowd of people, possession or use of pyrotechnics, fireworks, flares, during a sporting event, is punishable by imprisonment from six months to three years.
4. When any person participating in the sporting activity is harmed by the actions mentioned in the third paragraph, the imprisonment sentence is increased by up to one-half of it.
5. In any case, the court shall impose the additional penalty of prohibiting the perpetrator from participating in sports activities for a period of up to five years.
