The decision of the Special Court to postpone the announcement of the verdict in the case against former leaders of the Kosovo Liberation Army (KLA), Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi, has prompted numerous reactions.
Bedri Hamza, who leads the party that was initially led by Thaçi and then by Veseli, announced that he had a telephone conversation with Thaçi, from whom he conveyed a message to the citizens of Kosovo.
" President Hashim Thaçi asked me to convey his warmest greetings to all of you. With the calmness and trust that characterizes him, we ended the conversation with the hope that we will see each other in Kosovo very soon ," said the leader of the Democratic Party, after the telephone conversation with Thaçi.
Hamza said that the postponement of the decision reconfirms that the Special Court in The Hague is acting more as a political instrument than as a court guided by the principles of justice.
"We also spoke about the long wait for justice, a wait made worse by the constant postponements of the verdict. However, one thing remains clear: justice can be delayed, but it must not be alienated. I conveyed to the President the greetings, expectations and support of the citizens of Kosovo, as well as the belief that on September 16, justice will be done and they will return home free ," Hamza wrote.
The day before, the Special Court set 10:00 a.m. on September 16 to announce the verdict against former KLA leaders, who are accused of war crimes and crimes against humanity, allegedly committed during and immediately after the war in Kosovo.
“ In the order setting the date, the trial panel explained that the time required for the deliberations had been extended in accordance with the Rules, due to the large volume of evidence received and the complexity of the trial, and that this extension was justified by the need to make a reasoned, comprehensive and fair assessment of the case documentation ,” the Special Chamber’s decision states.
Initially, the panel had until May 19 to announce the verdict. However, citing the complexity of the case, it decided to extend this deadline until July 20. It also left open the possibility of postponing the announcement of the verdict beyond this date. The KLA War Veterans Organization has considered the decision to postpone the announcement of the verdict unfair and unacceptable.
“Shtyrjet e njëpasnjëshme, të maskuara si përgjigje ndaj vëllimit dhe kompleksitetit, vërtetojnë atë që kemi theksuar që në fillim: ky proces është thjesht në shërbim të politikës së Serbisë dhe aleatëve të saj, me qëllim që ta ulë në bankën e të akuzuarve Luftën Çlirimtare, ndërkohë që amniston makinerinë gjenocidiale të shtetit fashist serb, duke e shpëtuar nga llogaridhënia. Asnjë kalendar gjyqësor nuk e rishkruan themelin e lirisë së Kosovës, luftën e drejtë për mbijetesë. Misionin që dikur e kishte EULEX-i, po e vazhdon me besnikëri Haga, ndërkohë që qasja e disa qarqeve ndërkombëtare, që shpesh deklarohen si partnere të Kosovës, ka krijuar barriera të vazhdueshme ndaj vlerave të Luftës Çlirimtare dhe ka penguar zhvillimin e plotë të vendit tonë”, thuhet në reagim.
Në reagimin e Organizatës së Veteranëve të Luftës së UÇK-së është paralajmëruar edhe protestë.
“Kjo situatë nuk mund të tolerohet më. Rezistenca jonë do të zhvendoset në rrugë përmes protestave, duke mos përjashtuar mundësinë e përshkallëzimit të tyre nëse zëri ynë vazhdon të injorohet”, thuhet në reagim.
Thaçi, Veseli, Selimi dhe Krasniqi ndodhen në paraburgim në Hagë prej më shumë se 5 vjetësh. Prokuroria i ka akuzuar se, si pjesë e një “ndërmarrjeje të përbashkët kriminale”, synonin marrjen dhe ushtrimin e kontrollit përmes frikësimit, keqtrajtimit dhe eliminimit të kundërshtarëve. Sipas aktakuzës, viktimat e tyre përfshinin serbë, romë dhe shqiptarë që nuk mbështesnin UÇK-në. Në përfundim të procesit, prokuroria kërkoi dënim me nga 45 vjet burg për secilin prej katër të akuzuarve.
Por, ish-presidenti Thaçi, ish-kryeparlamentarët Krasniqi e Veseli, si dhe ish-deputeti Selimi kanë kërkuar lirimin, dhe i kanë mohuar akuzat.
Avokati Artan Qerkini ka theksuar se procesi në Hagë është shoqëruar me një sërë shqetësimesh procedurale.
“Një nga çështjet kryesore mbetet shkelja e të drejtës së të pandehurve për t’u gjykuar brenda një afati të arsyeshëm. Po ashtu, është kritikuar edhe kohëzgjatja e paraburgimit, si dhe fakti që disa materiale hetimore u janë dërguar të pandehurve në gjuhën angleze, pa përkthim të plotë në gjuhët e tyre”, ka thënë Qerkini.
Gjatë procesit në Hagë, në mbështetje të mbrojtjes kanë dëshmuar disa prej figurave më të njohura të diplomacisë dhe sigurisë perëndimore të kohës së luftës, përfshirë ish-zëdhënësin e Departamentit amerikan të Shtetit, James Rubin dhe ish-komandantin e NATO-s për Evropën, Wesley Clark. Ata kanë deklaruar se UÇK-ja nuk funksiononte si një strukturë e centralizuar dhe se të akuzuarit kishin më pak ndikim dhe kontroll sesa pretendohet në aktakuzë.
Dy profesorë e njohës të zhvillimeve në Kosovë e Ballkan, Daniel Serwer e Edward Joseph, kanë pasur mendime të ndryshme për vendimin e së mërkurës të Gjykatës Speciale. Serwer ka thënë se kjo mund të jetë sinjal se gjyqtarët kanë vështirësi për ta marrë vendimin.
“ I don’t know exactly how to interpret this. The longer it takes, in a way the better it is because it’s a clear sign that they are having difficulty making a decision. As you know, I am not happy with this court and I think it acted unfairly by keeping these people in prison for five years. And I think it is wrong to change the focus of the court, which was supposed to deal with the allegations of the Marty report about organ trafficking ,” Serwer said.
And, Joseph stressed that it is extremely disappointing that the Special has decided to postpone the verdict.
"I think this reflects and raises additional questions about the competence of these Specialist Chambers, which have taken so long and have held these individuals for such a long period, and the fact that they are delaying this decision I think reflects very badly on the Specialist Chambers," he said.
The former KLA leaders have been held in custody in The Hague since November 5, 2020. The Trial Panel concluded the evidence presentation phase on December 18, 2025. Closing statements were held from February 9 to 18, 2026. 134 witnesses have testified in this court case.
