
Mayor Erion Veliaj's lawyers, in a reaction to Top Story, listed the defense arguments that, according to them, prevent Veliaj's dismissal.
According to the defense, Erion Veliaj cannot be dismissed as long as there is no final decision against him and as long as he has not been arrested in flagrante delicto, committing a crime on duty.
Veliaj, the lawyers say, has the right to appeal to the Constitutional Court against the government's decision to dismiss him. Erion Veliaj has the right to appeal to the Constitutional Court. Until the Constitutional Court makes its decision, the government's decision is suspended.
Veliaj, the incumbent mayor and elected with over 160,000 votes, is unable to exercise his duties because he is in detention, not because of his own free will.
The lawyers further raise the question of whether the Municipal Council will implement the constitutional requirement for due process, inviting the Mayor to speak and defend himself before it.
Following the statement of Prime Minister Edi Rama, who a few days ago also requested the initiation of procedures for the removal of Erion Veliaj from the leadership of the Municipality, the socialist members of the Municipal Council gathered today to prepare the request for the dismissal of Veliaj, highlighting the 3-month absence of the mayor from office. Further, it was decided that this request will be reviewed on September 23 in the Municipal Council. Meanwhile, the call for Veliaj to speak in the Council before the vote has not been discussed.
