The Tirana Prosecution Office has closed the investigations into the murder of construction businessman Eduart Reçi on November 13, 2024 and has sent the two brothers, Shkëlqim and Florian Dukaj, to trial.
The two brothers have been arrested as suspected perpetrators of the murder of businessman Reçi, following conflicts over a property where the latter intended to build.
It is learned that Eduart Reçi was engaged in building a palace, the construction of which required cooperation and agreement with other people, bordering his property.
The construction businessman, who was once an employee of SHISH, received a single bullet to the head and was taken to Trauma, but did not survive.
The incident occurred on Wednesday evening (November 13) at around 11:00 PM, on "Faik Konica" Street, and it is learned that security cameras only filmed the moment when the victim was shot and fell to the ground, but not the assailants.
Investigators say the victim, Eduart Reci, had built two mansions and a villa in Tirana over the years and had rented out the residential and commercial units. There had been ongoing disputes between him and the Dukaj brothers over a piece of land that, according to the Prosecution, was occupied by their bar.
The official announcement states that Shkëlqim and Florian Dukaj had built the bar without a permit on a piece of land owned by Reç and that the debates on this issue had been going on for years. The prosecution claims that for financial reasons, the two brothers drew up a detailed plan to eliminate Reç. According to the indictment, they studied the time, place and method of execution, conducted shooting at the shooting range, secured weapons and binoculars for the nighttime operation and threw fireworks in the yard of the victim's bar to ambush him.
The businessman was the father of two children, while family members stated that they had no conflicts.
How did the incident happen?
Everything seemed calm that evening of November 13, 2024. Every now and then the silence was broken by the sound of fireworks, which had actually started going off 5 days ago.
And actually not without purpose. What the police later discovered, explained that the fireworks were part of a murder plan. So much so that the residents of the area got used to that noise and did not understand the firing of a gun.
Eduart Reçi, a 52-year-old builder, had gone out and was walking in the courtyard of the building he had built himself, on "Faik Konica" Street, opposite the Faculty of History and Philology. He was looking at something on his phone or trying to make a call, when he suddenly fell to the ground.
It was 10:40 PM when a bang was heard from no one knew where it came from and which to everyone seemed like some kind of fireworks that they had been accustomed to hearing around there for 5 days.
Security camera footage showed that someone had targeted him and shot him from a distance, as no one was seen near him, or around him.
The prosecution's full response:
The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, completed the investigations and sent citizens FD and Sh.D. to trial for the criminal offenses of 'Premeditated Murder' committed in collaboration, 'Illegal Possession and Production of Weapons' and 'Illegal Production, Possession, Purchase or Sale of Cold Weapons' provided for by articles 78, pg.2 and 25, 278 and 279, pg.1 and 25 of the Penal Code.
From the investigations into criminal proceedings no. 7559 of 2024, it resulted beyond any reasonable doubt that the person under investigation Sh.D., in collaboration with his brother FD, committed the premeditated murder of the victim ER.
The investigation revealed that the victim ER has built two buildings and a villa in Tirana over the years and has rented out all the residential units, garages, commercial units, villas, etc. to various people. Among the people with whom the victim had a dispute over ownership issues are the brothers Sh.D. and FD, owners of a bar that bordered the bar owned by the victim, as part of the defendants' bar was built on the victim's land.
From the overall assessment of the evidence and important indications administered, which are accurate and consistent with each other, it is established beyond any reasonable doubt that the person under investigation Sh. D. in collaboration with his brother FD, is the author in the role of executor of the attempted murder of citizen ER on 08.11.2024 and then of his murder on 13.11.2024, with premeditation as well as of the commission of the criminal offenses of illegal possession of firearms and cold weapons in collaboration.
The person under investigation Sh. D. committed the murder of citizen ER with premeditation for financial gain, that is, he made the decision to commit the murder calmly together with his brother, preparing the criminal plan for its implementation together. He has foreseen all the circumstances for the commission of the murder related to: preparation to have accuracy in carrying out the murder by shooting at the range, securing a weapon and binoculars to carry out the murder at night and from a distance, choosing the place of commission of the crime in order to carry out the murder and not expose himself, ambushing the victim by throwing firecrackers in the yard of his bar, committing the crime secretly and taking measures to avoid criminal liability.
In order to carry out the murder, in addition to the actions to secure the weapon, the person under investigation, together with his brother, studied in detail and determined the time and place where they would carry out the murder, with the aim of both not being detected and escaping criminal liability. According to a detailed plan, they decided to carry out the murder of citizen ER at night in order not to be exposed and identified by cameras or people. Being aware that the victim would go out in the evening to clean the yard, the defendants decided to carry out the murder at a distance, from a position where there was a view of the yard in front of the victim's premises and so that the executioner would not be monitored by cameras and away from people's eyes.
The person under investigation Sh. D. together with his brother did not have good relations with the victim ER because the persons under investigation had built the premises without permission for many years and had occupied part of the land owned by the victim. Although this problem had been discussed between the victim and the persons under investigation, given Sh. D.'s position as a police officer, the victim was reluctant to resolve the matter in court, and had asked them to release him voluntarily. Since the victim had proposed to them to build a building, the persons under investigation understood that in the event of the building being built, the victim would claim his property and they would be encroached upon the land they had unjustly occupied, both for the part belonging to the victim and for the other part where they had built the premises without permission on land that was not their property. In these circumstances, for material interest, they decided to carry out the murder of citizen ER
