Operation Vanilla remains for me, undoubtedly, one of the rarest and most profound successes of European police and judicial cooperation. The infiltration of the Sky ECC platform, the decoding of hundreds of millions of messages and the identification of organized crime networks operating simultaneously on several continents, constitute a true treasure trove of information.

For the prosecutors of many countries, including Albanian ones, this material has opened doors that were previously closed, has made possible investigations that under normal conditions would remain incomplete, and has led BKH to doors that no one thought would be knocked on.

I have previously analyzed this operation and supported SPAK's approach to its use. Until the moment when serious questions were raised about the wiretapping of Constitutional Court judges, the content of which still remains a mystery to the public, but not to me. At that point, the boundary between the need for investigation and respect for the independence of the judiciary became clear and unavoidable. Definitely criticizable!

But the debate over Sky ECC does not end there. Today it is entering a second, deeper and more procedural phase.

For almost five years, the debate has revolved almost exclusively around one question: are wiretapping and decoded materials legal?

Lawyers, in Albania and beyond, have mainly challenged the authorizations, the competence of the French authorities, the use of the European Investigation Order, the chain of custody of evidence and the technical reliability of the material. In the vast majority of cases, these objections have not been successful.

But in the meantime, a much more delicate point has remained almost out of the debate: Not the way the evidence was collected, but: does the defense really have the opportunity to challenge it in the country where it was created?

This is the critical question that is dominating European courts today.

The recent decision of the Corte di Cassazione in Italy does not overturn the Sky ECC evidence, but rather adds an element that profoundly changes the procedural analysis: the court accepts that the defense should be given the opportunity to activate a new OEI towards France, in order to preserve the documentation of the operation and exercise the procedural rights offered by the French system.

In other words, the problem is not just the evidence. The problem is the right to control the evidence.

Nëse lexohet me kujdes ky vendim, krijohet përshtypja se gjykatat po korrigjojnë një dobësi që vetë avokatët nuk e kishin ngritur në mënyrë të plotë në vitet e para. Energjia është përqendruar tek ligjshmëria e operacionit, ndërsa shumë më pak është diskutuar një pyetje tjetër: çfarë ndodh me të drejtën e mbrojtjes kur prova prodhohet në një shtet, ndërsa procesi zhvillohet në një shtet tjetër?

Nuk mjafton që prova të transferohet përmes një OEI. Duhet të ekzistojë edhe mundësia reale që mbrojtja të kërkojë dokumentacionin origjinal, të verifikojë integritetin e tij dhe, nëse është e nevojshme, ta kundërshtojë atë në juridiksionin ku është krijuar. Pikërisht këtë po kërkojnë sot gjykatat.

Këtu lind paradoksi dhe pika kritike e kësaj faze të dytë.

Franca prodhon provën. Italia, Belgjika, Holanda, Shqipëria dhe shumë shtete të tjera e përdorin atë. Por personi që gjykohet jashtë Francës mund të mos ketë një mjet procedural efektiv për ta kundërshtuar pikërisht në Francë.

Ky paradoks është bërë tashmë objekt i referimit paraprak nga Cour de cassation franceze në çështjen C-625/25 pranë Gjykatës së Drejtësisë së Bashkimit Evropian.

Pyetja është themelore: a është i pajtueshëm me të drejtën e BE-së një sistem ku prova prodhohet në një shtet, por personi i gjykuar në një shtet tjetër nuk ka një mjet efektiv për ta kundërshtuar atë?

Përgjigjja e kësaj çështjeje mund të ndikojë në të gjitha procedimet që mbështeten mbi Sky ECC.

Dosja “Aruba” dhe realiteti shqiptar

Edhe në Shqipëri një pjesë e rëndësishme e procedimeve të SPAK-ut mbështetet mbi të njëjtin material të ardhur nga Operacioni Vanilla dhe nga hetime të lidhura të autoriteteve franceze, spanjolle e belge.

Dosja “Aruba” është shembulli më i fundit. Komunikimet e zbërthyera në Sky ECC kanë shërbyer si bazë për të lidhur takime të dyshuara (në Aruba, Mallorca, Belgjikë e gjetkë) me skema të pastrimit të parave në tregun shqiptar të pasurive të paluajtshme. Sipas materialit hetimor, këto biseda kanë orientuar dyshimet drejt investimeve në kulla në Tiranë dhe në leje ndërtimi e investime strategjike. Në vazhdim të këtyre të dhënave, SPAK ka kryer kontrolle dhe ka sekuestruar dosje pranë Këshillit Kombëtar të Territorit.

Materiali Sky ECC në këtë dosje nuk është prodhuar në Shqipëri. Ai vjen nga operacione të kryera jashtë vendit dhe është transferuar përmes kanaleve të bashkëpunimit ndërkombëtar.

Deri tani, në praktikën shqiptare, ky material është trajtuar shpesh si i gatshëm për t’u përdorur. Por zhvillimet e fundit në Catanzaro, Imperia dhe në Spanjë tregojnë se kjo qasje nuk është më e mjaftueshme.

If the European standard begins to require access to original documentation, to raw material, to the chain of custody of evidence and, above all, to the existence of an effective means of protection in France, then Albanian courts will also face the same questions. And this does not only affect the “Aruba” file. It affects the entire line of investigations that are built on the same material.

The first stage of the debate was: is the evidence legal?

The second phase seems to be taking place: did the defense have a real opportunity to challenge it?

This change is much more important than it might seem. Because it does not attack the police operation. It does not call into question the fight against organized crime. It only requires that even the strongest evidence pass the same standard of scrutiny that any state governed by the rule of law requires.

The challenges between lawyers and SPAK are not over. They have just entered a new dimension, one that has highlighted the weaknesses of the defense system and the boundary between the proportionality of the fight against organized crime and the right of the defense to challenge evidence in its country of origin.
