At the end of January 2026, the Parliament adopted a law on the import and transit of military weapons. The law provides for transit and re-export by private entities, as well as simplified declaration procedures under the Customs Code. The provisions for verbal declaration and exemption from physical presentation of goods have raised debates on the level of control and the risk of abuse, at a time when Albania faces reported challenges in the field of arms trafficking.
While the territory of Albania is mentioned in reports by American and European partner agencies as a risk area for arms and ammunition trafficking, on January 28, 2026, Parliament silently approved a law submitted by the government on the import and transit of military weapons.
Albania, as a NATO member country, has interstate agreements and agreements with the Military Alliance for the circulation and trade of weapons, which undergo detailed customs and police control for quantity, types, origin of production and purchase, country of origin and purpose of use.
The content of the law also defines customs spaces and tolerances for the transit and re-export of weapons in bulk by private entities, while the title of the law only uses the term "import and transit".
The law includes firearms disguised as other forms, explosive military shells and delivery systems, automatic weapons converted to semi-automatic, short and long guns.
Also included are high-penetration ammunition, explosive or incendiary shells, ammunition for pistols and weapons converted to fire blanks, irritants or pyrotechnic cartridges.
Foreign importing entities may be granted authorization for the above-mentioned armaments when they request temporary admission for evaluation or active processing for repair, with the right to exit the territory of Albania through re-export.
These are non-Albanian goods that enter and pass through the customs territory of Albania, placed under a transit regime with a final destination in another country.
Any person who holds a firearms license is allowed to manufacture, purchase, possess or trade weapons and, according to the law, has the right to import and transit them in the Albanian customs territory without a special import authorization, but with simplified declaration and reduced data on the weapons.
Article 152 of the Customs Law, to which the Law on the Import and Transit of Armaments refers, provides that the simplified declaration allows the placement of goods under the customs regime even with a verbal declaration, avoiding the presentation of certain data in the accompanying documents.
Article 165 provides that the customs authorities, upon application, may exempt the declarant from the obligation to physically present the goods.
These provisions, which allow the import and transit of weapons with a stay of up to 90 days in Albania, have raised concerns about the possibility of abuse and increased risk in arms control.
